This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested: We are requesting a full list of the following information for all exempt Rowan CWA employees furloughed any amount of time in the month of July including:
-Full Name
- Rowan email address
- Dates of July 2020 furlough
The purpose of this request is that there have been multiple reports made by furloughed exempt, Rowan CWA employees across campuses that they have been pressured to continue working in some degree by supervisors during furlough days. As Rowan HR likely knows asking furloughed employees to send even a single email would make Rowan liable to pay these employees their entire weekly salary due to the Fair Labor Standards Act.

With my apologies, we inadvertently were speaking with a law firm Schorr & Sterling, and sought an extension. We did not realize, nor did the law firm, that this request did not come from them. This email address is our only contact information associated with this request.
Therefore, please be advised that we are working on providing a response to this request, but will need an additional 60 days from the July 2, 2020 date of the request to provide a response. First, that information is not readily available in one document. Second, as you are aware, Rowan has furloughed a significant number of employees in the month of July and this, along with our continued policy of remote working due to the pandemic, impacts our ability to provide a timely response.

Dear Rowan University,
Please pass this on to the person who conducts Open Public Records Act reviews.
I am writing to request an internal review of Rowan University's handling of my OPRA request 'list of all Rowan exempt CWA bargaining unit employees that have been furloughed in July 2020'.
Rowan has broken the law by not responding or requesting time extensions to this OPRA request. It is unacceptable that a large, public institution so flagrantly skirts open public records legal requirements. Please correct these outstanding issues immediately for this request and others.

Rowan University has received your request for "an internal review of Rowan University's handling of my OPRA request 'list of all Rowan exempt CWA bargaining unit employees that have been furloughed in July 2020'". However, the request seeks and investigation for information and/or asks questions and does not identify a specific government record. As such, your request is an invalid OPRA request and is denied for that reason. Please see NJ Builders Assoc v. New Jersey Council on Affordable Housing. 390 N.J. Super. 166,180 (App.Div.2007). When a request is complex because it fails to specifically identify the documents sought, then the request is not encompassed by OPRA.
