The Monmouth County Prosecutor's Office is in receipt of the below Public
Record request.  The deadline to respond to this request was extended to
July 17, 2020.

 

Attached please find arrest reports and CAD reports with social security,
driver's license, and phone numbers redacted in accordance with N.J.S.A.
47:1A-5. Vehicle registration numbers are redacted as a "confidential
personal identifier" in accordance with R. 1:38-7(a) and N.J.S.A. 47:1A-9.

 

Police incident reports normally are exempt from disclosure under OPRA as
"criminal investigatory records."  N.J.S.A. 47:1A-1.1; see North Jersey
Media Group, Inc. v. Township of Lyndhurst, 229 N.J. 541, 569 (2017). 
This particular case began with a report of an abandoned vehicle.  It
initially was investigated as a possible suicide and/or missing person. 
The very first police reports and the CAD reports, which responded to and
treated the victim's disappearance in this regard, are being provided to
you, as they arguably do not "pertain to a criminal investigation."  North
Jersey Media Group, Inc. v. Township of Lyndhurst, 441 N.J. Super. 70,
104-07 (App. Div. 2015), rev'd on o.g., 229 N.J. 541 (2017).  Police
reports that followed the earliest ones did pertain to a criminal
investigation, some "albeit in its earliest stages," and therefore are
exempt from disclosure.  Id. at 104-05.

 

Phone, driver's license, and social security numbers are redacted from the
police reports in accordance with N.J.S.A. 47:1A-5.  Vehicle registration
numbers are redacted as a "confidential personal identifier" in accordance
with R. 1:38-7(a) and N.J.S.A. 47:1A-9.
