LexisNexis Audit Reports Searched by Brian Kubiel and TRFD1
Dear Toms River FD1,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
1. All contracts, subscription agreements, invoices, or payment records between Toms River Fire District No. 1 and LexisNexis Risk Solutions / Accurint, from January 1, 2019 to present.
2. A list of all employees, officials, or contractors of Toms River Fire District No. 1 who have been issued login credentials or licenses for LexisNexis / Accurint during the same period. This request specifically includes Administrator Brian Kubiel and any accounts created, assigned, or used under his authority.
3. All audit logs or reports generated by LexisNexis / Accurint showing:
• User ID or username of the individual conducting the search,
• IP Address, Date and time of each search, and
• The name, subject, or identifying information searched for all queries conducted by Toms River Fire District No. 1 from January 1, 2019 to present.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Your September 10th email claiming that no records or agreements exist is as careless as it is false. I hold the paid bill dated April 2, 2025 for $242.55 in hand, assigned to District 1, and it’s even recorded in your own meeting minutes. Yet somehow, after your “extensive search,” you managed not to find it. That isn’t transparency it’s incompetence.
LexisNexis is not a copier lease or office supply. It is a forensic background tool, reserved for law enforcement, and yet District 1 is paying for it under your administration even though, your background checks are submitted through the Toms River Police Dept and you have threatened to come after me multiple times. Denying the existence of records that taxpayers are already billed for proves you either can’t manage the simplest task of record keeping or you’re deliberately obstructing. Neither inspires confidence.
If you are unable to provide documents that are plainly sitting in your own minutes, then you have no business serving as custodian of records. However, your denial of records raises far more questions about compliance and irregularities done by you, as fire administrator, than if you acknowledged the existence of them.
I would like the records requested by end of business day, or I will file complaints.

First you denied the existence of any such records, and now you clearly know exactly what program I am referring to. Since the existence and use of the LexisNexis subscription is no longer in question, please provide the complete set of documents from my original OPRA request without further delay. Ironically, he could't even find that bill until it was shown to him after an "extensive search". Please provide the requested information.
