I write in response to your public records request seeking a “Historic
Summary List of Letters of Agreement/Contracts between Middlesex County
and service agency providers, care management and support services for
seniors and the disabled from 2005 to present. (social and adult day care,
respite, assised living, transportation, home health, housing, alzheimers
and memory care, etc).”

Under N.J.S.A. 47:1A-1.1, et seq., requestors must identify specific
documents being sought and does not require records custodians to
interpret overly broad requests to search for "every document" or "all
documents.” See Bent v. Township of Stafford Police Dept., Custodian of
Records, 381 N.J. Super. 30, 37, 39 (App. Div. 2005).

It is the requestor's obligation to specifically describe the documents
that are being sought. The request may not be a broad, generic description
of documents as the custodian is not required to speculate about what the
requestor seeks and is not required to survey agency employees regarding
the request. Bart v. Passaic County. Pub. Hous. Agency, 406 N.J. Super.
445, 451-52 (App. Div. 2009). Your request seeks twenty years of
agreements with specific types of care providers.  However, the County’s
records are not organized in such a manner and accordingly your request
would require the custodian to review every single contract over that time
frame to determine if it involves one of the car providers identified in
your request. 

Such research is not a permissible request under OPRA. If however you can
provide for more specific information, such as identifying a specific
agreement or a specific vendor, we can search for those records
accordingly.
