Enoteca Ursino Restaurant to Open at Kean University on 5/25

The Terra Momo Restaurant Group, known for its "taste of place" culinary philosophy, will open its fourth New Jersey restaurant in Kean University's STEM building on Morris Avenue on May 25, 2016. Enoteca Ursino at Kean University will offer a farm-to-table, Italian-inspired menu in a welcoming, energetic atmosphere, featuring a variety of local sources and organic produce grown at the adjacent Liberty Hall Farm at Kean University.

Re:      Request for Clarification of 06/29/2020 OPRA Request

 

Dear Ms. Mary Roman:

 

Kean University originally received your Open Public Records Act (OPRA)
request on June 29, 2020.  As such, the initial seven (7) business day
deadline to respond to your request is Thursday, July 9, 2020. 

 

Your requests sought access to the following government records:

Please provide all  records, including emails, insurance coverage for
Enoteca Ursino Restaurant, aka Enoteca Ursino, aka Terra Momo Restaurant
Group

 

Please be advised that your OPRA request is vague and overly broad, thus
failing to adequately identify the specific government records sought, as
is required by Bent v. Stafford Police Department, 381 N.J.Super. 30, 37
(App. Div. 2005).  The Open Public Records Act (OPRA) provides public
access to specific non-exempted government records, as defined by the
Act.  However, “[a] records request must be well defined so that the
custodian knows precisely what records are sought,” and should not require
the records custodian to perform research or undertake a subjective
analysis to understand the nature of the request.  Paff v. Galloway Twp.,
229 N.J. 340, 355 (2017).  Additionally, a proper request under OPRA must
identify with reasonable clarity those documents that are desired, and a
party cannot satisfy this requirement by simply requesting all of an
agency’s documents. Accordingly, we seek clarification of your OPRA
request at this time. Please respond in writing and identify with
reasonable clarity the specific government records you seek.  Failure to
provide written clarification of your request by July 16, 2020 will result
in the closure of your OPRA request.

 

In addition, the portion of your request regarding insurance records does
not appear to be directed at Kean University, but rather appears to be
directed at the Kean University Foundation, Inc.   Please be advised that
Kean University does not make, maintain, file or receive copies of the
specific requested records.  Further, Kean University is not responding on
behalf of the Kean University Foundation, Inc.  Any request or portion of
a request for Foundation records should be directed to the Kean University
Foundation, Inc.
