John Clarke Personnel Info/Records
Dear New Brunswick Housing Authority,
Under NJSA 47:1A-10, NJSA 47:1A-5(e), and the common law right of access, please provide immediate access to the following information/records regarding employee John Clarke:
1) current title/position
2) current salary
3) payroll records sufficient to show total compensation paid out each year since the initial hire
4) start date for employment
5) promotion date(s) for current title/position and each title/position held previously
Yours faithfully,
Charlie Kratovil
Mr. Clarke,
I submitted this request on July 20 and received no response. On August 2, I printed out a copy of the request and handed it to Evette at the NBHA office. She said you were not in the office and she would give it to you upon your return. Why haven't I received any response to this request? As you know the NBHA is also out of compliance with the OPRA in regards to my other request dating back to May 3.
I don't mean to be a pest, but my requests are basic and the responses should be prompt. If you need an extension of time to respond, you should communicate that. But you have not communicated with me at all about the July 20 request, and as I've noted previously, you are running the risk of getting the NBHA sued by failing to comply timely with the requirements of the OPRA.
Yours faithfully,
Charlie Kratovil

Dear Mr. Clarke,
I received your August 15 response to this request. In your response you indicated: "With regard to Item #3, the Housing Authority hereby requests an additional seven (7) days to search for responsive records."
I have received no further communication regarding this request. Did you complete your search for responsive records? When can I expect to receive the requested information?
Yours sincerely,
Charlie Kratovil
Dear Mr. Toto,
Unfortunately, your predecessor Mr. Clarke left several of my pending OPRA requests unfulfilled, and the authority has been recklessly risking legal liability by not complying with the state statute NJSA 47:1A.
Mr. Clarke provided a partial response to my July 20 request for personnel information/records about him. On August 15, Mr. Clarke requested an additional seven days to provide the payroll records sufficient to show total compensation paid out to him each year since he was hired. I never heard from Mr. Clarke again regarding this request. Please provide the requested records.
Yours faithfully,
Charlie Kratovil
