third and last day being Friday, March 18, 2022.  I’m seeking guidance
from our law department on my findings before I can present them to you.

Good Morning,

Below is the breakdown of your OPRA followed by my findings:

• PER NJSA 19:31-16, COPIES OF THE JERSEY CITY MONTHLY DECEDENT
RESIDENCE REPORTS FOR JANUARY 2019 – PRESENT
• Do to the attachment size limitations, I am unable to attached to the
file to this e-mail.  Instead I have uploaded the file to a FTP size. 
Please click on the link below to download the file.  The link will
only be active for 14 days, starting today (3/18/22).  After which the
link will stop being active on the 14^th day (4/1/22).

When you open the file you will notice two pieces of information has been
redacted.  The deceased address and the deceased state file number.

The state file number (also known as the New Jersey Death Certificate
Number) has been redacted as per NJ 8:2A-2.2(g) which allows the state
registrar or other custodians of vital records not to permit vital
information on the death certificate unless the applicant (or the
requester) is authorized to obtain a full copy of such record under NJ
8:2A-2.1 or NJ 8:2A-2.2.

The addresses of the deceased have been redacted as per NJ 47:1A-2.2C
which states:

• “a custodian shall not comply with an anonymous request for a
government record which is protected under the provisions of this
section”
• The provision of the above section is referring to NJ 47:1A-2.2A which
states:

◦ “Notwithstanding the provisions of P.L.1963, c.73 (C.47:1A-1 et
seq.) or the provisions of any other law to the contrary, where
it shall appear that a person who is convicted of any indictable
offense under the laws of this State, any other state or the
United States is seeking government records containing personal
information pertaining to the person's victim or the victim's
family, including but not limited to a victim's home address,
home telephone number, work or school address, work telephone
number, social security account number, medical history or any
other identifying information, the right of access provided for
in P.L.1963, c.73 (C.47:1A-1 et seq.) as amended and supplemented
shall be denied.”

Since you submitted this OPRA anonymously, I cannot confirm or deny that
you have or haven’t been convicted of any indictable office under the laws
of New Jersey, any other state or the United States; and therefore I have
to redact the addresses of the deceased.
