Records requested:

This accident occurred on June 13th, 2025, at the intersection of
Jersey Ave and 6th St, at approximately 4pm, involving a UPS vehicle

Your request for the body worn camera footage, dash camera footage, scene
investigation photographs as well as all surveillance camera footage
pertaining to the fatal accident involving a minor on June 13, 2025 is
hereby denied pursuant to N.J.S.A. 47:1A-1 which states that “a public
agency has a responsibility and an obligation to safeguard from public
access a citizen’s personal information with which it has been entrusted
when disclosure thereof would violate the citizen’s reasonable expectation
of privacy.”

In Asbury Park Press v. Ocean County Prosecutor's Office, the Court ruled
that documents can be withheld pursuant to a person’s reasonable
expectation of privacy when the content of the document would “offend and
disturb any person of normal sensibilities.” See Asbury Park Press v.
Ocean County Prosecutor's Office, 374 N.J. Super. 312, 330. This case
involved an OPRA request that sought access to a 911 call recording that
was made during the commission of a double homicide and contained one of
the victim’s last words. In regards to the release of such records under
OPRA, the Court stated, “it is impossible to imagine what the impact would
be on the victim's family and loved ones. It is equally inconceivable that
the Legislature would have ever intended that OPRA would have been used as
the instrument to put those words, either as spoken or transcribed, in the
public domain. Therefore, it is beyond doubt that the victims' survivors
would reasonably expect that they would never have to share their loved
ones' words with an inquisitive media or curious public.” Id. at 330.

Applying the same reasoning here, it is beyond doubt that the decedent’s
parents would reasonably expect that they would never have to share images
of their dead child’s body with an inquisitive media or curious public,
and that such images would “offend and disturb any person of normal
sensibilities”. Consequently, your OPRA request is denied.
