Jason Carty arrest and incident reports
Dear Lumberton Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
1. Any and all incident or arrest reports involving police being called to the residence of Jason Carty at 10 Middleton Dr., Lumberton, NJ, from January 2020 through the present date, October 2024.
2. Any body camera footage related to these incidents, including but not limited to the weekend of October 27, 2023.
3. All information and documentation pertaining to any incidents during this period, particularly any related to the arrest of Mr. Carty and the citation and mandatory stipulations given to Mr. Carty.
4. Any incident reports, documentation, or complaints where children were present in the home at the time of police presence, especially the weekend of October 27, 2023 or any complaints made by neighbors regarding the welfare of the children at the residence during these incidents, as there have been multiple concerns from neighbors in the township.

The Township of Lumberton received your Open Public Records Act (OPRA) request on October 22, 2024. The Official Records Custodian, Bobbie Quinn, received your OPRA Request on October 22, 2024. As such, the seven (7) business day deadline to respond to your request is October 31, 2024. This response is being provided to you on the 1st business day after the custodian’s receipt of said request.
Please note the following:
Redactions have been made in accordance with N.J.S.A.47:1A:1-1. Moreover, provisions of (OPRA) shall not abrogate any exemption of a public record or government record from public access heretofore made pursuant to (OPRA); any other statute; resolution of either both Houses of the Legislature; regulation promulgated under the authority of any statute or Executive Order of the Governor; Executive Order of the Governor; Rules of Court; any federal law; federal regulation; or federal order. N.J.S.A. 47:1A-9(a); see also VanBree v. Bridgewater Twp. Police Dept. (Somerset), GRC Complaint No. 2104-122 (October 2104), N.J.S.A. 2C:25-33 states that all Domestic Violence records pursuant to the act shall be confidential and shall not be made available to any individual.
Please be advised that a search of our files indicates that there are no Body Worn Camera files made, maintained or kept on file by the Township’s responsive to your request as the Lumberton Township Police Department is required to maintain said information for 180 days and in certain cases may be longer depending on the type of case; however, none were round relative to your request.
In accordance with the any Supreme Court Order granting automatic expungements pursuant to N.J.S.A. 2C:52-6 and N.J.S.A. 2C:52-6.1, an expungement order granted pursuant to N.J.S.A. 2C:52-15(a), or when a case is ordered sealed from public access at the time of sentencing/adjudication, the records that are subject of the order must be removed and/or isolated. Therefore, to the extent there are any responsive records related to this portion of this request, the request is denied.
This response is being transmitted to you via email. Pursuant to N.J.S.A. 47:1A-5.b., the total cost associated with this request is zero and thereby said OPRA Request is closed.
