Jason Boehm Correspondence to Sussex County Board of County Commissioners
To the Records Custodian:
Pursuant to the Open Public Records Act, N.J.S.A. 47:1A-1 et seq., I request access to and copies of the following government records in the possession, custody, or control of Sussex County, including but not limited to the Sussex County Board of County Commissioners, the Clerk of the Board, the County Administrator, and any County office or official who received, reviewed, routed, forwarded, discussed, or responded to the records described below.
Because this request identifies a specific sender, specific recipients and offices, specific subject matters, and a defined date range, it should be processed through reasonable electronic and manual searches of County records. Please do not delay or deny production based on generalized burden objections where responsive records can be located through the names, offices, and search terms identified below. If any responsive record is withheld, redacted, or otherwise not produced, please state with specificity the exact legal basis for each withholding, identify the category of record withheld, and produce all reasonably segregable portions. For the avoidance of doubt, this request is not made to harass any public agency or employee, and it is not made for use in litigation. I have not been convicted of any criminal offense.
Date range: August 1, 2022 through the date this request is processed.
I request all records of any kind sent by, received from, addressed by, or otherwise attributable to Stillwater Township resident Jason Boehm, including but not limited to emails, letters, memoranda, messages, attachments, screenshots, transmittals, delivery receipts, read receipts, forwarding records, and correspondence, that were sent to, copied to, forwarded to, received by, or maintained by:
the Sussex County Board of County Commissioners,
any individual Sussex County Commissioner,
the Clerk of the Board of County Commissioners,
the County Administrator,
or any other Sussex County employee or official acting in connection with the Board of County Commissioners,
where the subject matter concerns, mentions, or relates to any of the following:
Sussex County Community College;
SCCC;
Dr. Jon Connolly or Jon Connolly;
labor negotiations or union negotiations;
retaliation;
firearm or gun;
weapon;
blackmail or coercion;
workplace complaints;
employee complaints;
whistleblower complaints;
student support issues;
misconduct by college leadership;
requests for County intervention regarding SCCC;
or the matters described by Jason Boehm in his public comments to the Sussex County Board of County Commissioners in which he stated that he had emailed Commissioners and provided a “receipt” and a text message concerning alleged misconduct and unlawful interference in union negotiations.
This request specifically includes, without limitation:
Any email or other correspondence sent by Jason Boehm to any Sussex County Commissioner, the Board of County Commissioners, the Clerk of the Board, the County Administrator, or any County official or employee;
Any attachments to such correspondence, including text-message screenshots, photographs, PDFs, memoranda, letters, notes, or supporting documentation;
Any delivery confirmations, read receipts, metadata, logs, routing slips, or other records reflecting transmission, receipt, review, forwarding, or dissemination of such correspondence;
Any internal Sussex County emails, memoranda, notes, correspondence, or communications discussing, analyzing, routing, or responding to correspondence from Jason Boehm on the above subjects;
Any response sent by Sussex County or any County official to Jason Boehm concerning the above subjects;
Any records reflecting whether the matters raised by Jason Boehm were referred to counsel, human resources, law enforcement, SCCC, or any other governmental or oversight body;
Any calendar entries, meeting notes, agendas, or summaries reflecting meetings or discussions by County officials concerning communications from Jason Boehm on these subjects.
To assist in locating responsive records, this request includes records containing the following names and terms, whether in the sender, recipient, cc, bcc, subject line, body, attachment title, or file name:
Jason Boehm, Sussex County Community College, SCCC, Jon Connolly, Dr. Connolly, labor law, union negotiation, retaliation, blackmail, firearm, weapon, gun, whistleblower, workplace complaint, county intervention, student support, football players, soccer, international students, veterans’ liaison, receipt, text message.
I request that responsive records be produced in electronic format, preferably in their native electronic form where available, including emails with full metadata and all attachments intact. If native production is not available, please provide reasonably usable electronic copies.
If you contend that any portion of any responsive record is exempt from disclosure, please produce the non-exempt portions with redactions as necessary and provide a privilege log or written index identifying each withheld or redacted record by date, sender, recipient, general subject matter, and the specific legal basis for each withholding or redaction.
If this request is considered too broad in any respect, please do not deny it outright. Instead, please construe it in a reasonable manner and produce all clearly identifiable responsive records, including at minimum the original communication(s) from Jason Boehm to County officials and any direct responses or forwarding emails concerning those communication(s).
