Delran Fire District holds 'personnel records' at the district office within the township owned facility that is paid for by tax payers. The records are kept in a folder system alphabetical. The fire district is required by law to keep certifications on file such as Firefighter 1, EMT-B, etc.

I am telling you that the fire district does maintain certifications required by the State of NJ. I’ve seen the slide out draw before with individual names on labels of each folder. So stop saying they don’t maintain records there. This is all on a public forum right now, opramachine.com for everyone to see.

To Whom this May Concern: In the first instance, the District stands by the response initially provided to you in that the District does not maintain a “list” as requested by you. Second, and more important and extremely disturbing, is that you have admitted that you have accessed confidential personnel files belonging to the Delran Township Fire District. Unless you are an employee of the District authorized to do so, you have violated numerous laws as well as District policy. As such, I am demanding that you immediately identify yourself so that a full investigation can be undertaken with respect to what appears to be unauthorized access to confidential personnel records. If you do not do so, the District will have no alternative but to pursue any and all remedies available to it, including but not limited to seeking the assistance of law enforcement agencies. I trust you will respond accordingly.

To whom this may concern, all OPRA records are made anonymously. On top of that, active or inactive members are required to give a copy of certain certifications such as “EMT-B” or “Firefighter 1” To the district office to keep on file. You are now violating OPRA laws by withholding this request and saying the district office does not “maintain” these records. My lawyer will be in touch. The original request never requested a “list”, it requested a copy of each certification. Additionally, the district office does not maintain any “personnel records”, only “training records”.

Nevertheless, please be advised that neither I nor the District will engage with you any further until you identify yourself given that you have illegally accessed District records upon which your request is based. Nice attempt to spin this. You have violated OPRA laws on 3 requests that I have sent. Creating a list of the certification so the certification numbers aren’t exposed would have done, but the certifications will do. Stop trying to spin this, acting like someone illegally accessed something. You denied the district maintains a list. The district has to maintain a list of these records according to OSHA and have them readily available for inspection. These 3 OPRA request violations will be escalated costing tax payer dollars when you simply could have done your job and provided a copy or list of the certification.

Please pass this on to the person who conducts Open Public Records Act reviews.
I am writing to request an internal review of Delran Fire District #1's handling of my OPRA request 'James C Bauer Certifications'.
Once again, as a member active, inactive, or former member, we are required to give a copy of our certifications to the district office, LEA, and have them placed in our training file at the district office. This is the last time I’m going to request a copy of training certification, or my attorney will be in touch as well as the Government Records Council for denying 3 of my valid requests. You may wait for my attorneys call.
