Dear Jackson Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Dear Bethellen Gencarelli,

Thank you for the response. I believe your response is incomplete. On 12/5/2008 Officer Anuario was “terminated” but I believe you are legally required to provide a reason why Officer Anuario was terminated. Civil Action L3026-09 filed by former Detective Howard Bogan of your department references an indictment of Anuario for perjury on March 8, 2008 in paragraph 30 of his civil complaint but a review of the New Jersey Public Promis Gavel does not result in any complaint/indictment number. Kindly review your records and provide the reason Officer Anuario was terminated.

Pursuant t0 NJSA 47:1A-10, personnel records are not government records,
and are not subject to disclosure, except that “an individual's name,
title, position, salary, payroll record, length of service, date of
separation and the reason therefor, and the amount and type of any pension
received shall be a government record;” If, and only if, a document
otherwise classified as a personnel record fits within one of the listed
exceptions to the general exemption for personnel records, it becomes
subject to disclosure.

 

Jackson Township does not have a record stating why the officer was
terminated, just that he was terminated
