Records requested:
1. Total number of body cameras currently deployed in the police department.
2. Date on which body cameras were deployed to any of the police officers for the first time (year and month).
3. All invoices of body cameras purchases (if body cameras were purchased).
4. Dates of initial body camera assignment for each police officer currently employed.

Dear Mr. Kim,
This comes in response to your August 31, 2023 OPRA and Common Law Request
for: 1. Total number of body cameras currently deployed in the police
department, 2. Date on which body cameras were deployed to any of the
police officers for the first time (year and month), 3. All invoices of
body cameras purchases (if body cameras were purchased), and 4. Dates of
initial body camera assignment for each police officer currently employed.
Your OPRA and Common Law Request is technically improper, as it seeks
information (i.e. “total number of body cameras currently deployed in the
police department”) and not a readily identifiable public record. The
Custodian of Records is not required to perform research to determine
which documents exist, rather to make available to a requestor specific
record that have been identified by the requestor. See, Bent v. Stafford
Police Department, 381 N.J. Super. 30,37 (App. Div. 2005); see also, MAG
Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N. j.
Super. 534, 546-47 (App. Div. 2005) (the municipality does not have to
provide the information sought under OPRA if it fails to identify with any
specificity or particularity the governmental records sought and seeks
general information to be analyzed, collated and compiled by the
responding government entity which is not encompassed by OPRA).
However, the Livingston Police Department provided the following responses
(in bold) to your request:
1. Total number of body cameras currently deployed in the police
department.
- The total number of body-worn cameras currently deployed is 70.
2. Date on which body cameras were deployed to any of the police officers
for the first time (year and month).
- The date on which body cameras were first deployed was February 8th,
2022.
3. All invoices of body cameras purchases (if body cameras were
purchased).
– The requested documents were provided to you in our first response on
August 31st.
4. Dates of initial body camera assignment for each police officer
currently employed.
- Same response as in #2, February 8th, 2022.
