Interrogation video – Antwan Malone (2020 Newark case)

Dear Newark Police Department,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per N.J.S.A. 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

I am respectfully requesting access to the interrogation video footage of Antwan Malone (2020 Kidnapping and Execution case, victim John A. Sosa). Please provide the original, high-quality recordings of all interrogations conducted with Malone in connection with this case, including any pre- or post-interview segments, booking room, or holding-area footage if available.

If the Newark Police Department does not maintain custody of these records, I ask that you kindly forward or refer this request to the appropriate department or custodian of records so it may be processed without delay.

Good Afternoon:
  As a threshold matter, you have directed your request to the wrong
government agency as interrogation video, if it exists, would be
maintained by the prosecutor's office. Additionally, interrogation video
is not accessible under OPRA. N.J.S.A. 47:1A-1.1, which protects security
measures as well as N. Jersey Media Group, Inc. v. Twp of Lyndhurst, 229
N.J. 541, 569 (2017) exempts witness statements. 
However, note that custodial interrogations are ordinarily recorded and
admitted into evidence, where they become court records. If a person were
interested in interrogation video, that person could reach out either to
the Court that heard the trial in question, the defense counsel, or
prosecutor's office. 
Also, if you would like to make OPRA requests, rather than sending them to
individuals, who may be on vacation or re-assigned, sending them through
the portal guarantees that someone will see and process them. The link to
