I previously requested the number of Cyber-Tips and arrests made as the result of the investigation of Cyber-Tips received by the Ocean County Prosecutor's Office during the year 2019. On September 6, 2022 the response from the OCPO was:
"Mr. Boero,
This Office is not in possession of the requested records. Please direct
your request to the New Jersey State Police Internet Crimes Against
Children Unit.

Dina Khajezadeh"
The NJ State Police responded with:
2019 - 131 Cybertips
2020 - 142 Cybertips
2021 - 297 Cybertips
2022 - 372 Cybertips
Could you kindly check the High-Tech Crime module in InfoShare and/or the ICAC Data System and report the number of arrests the Ocean County Prosecutor's Office recorded for 2019, 2020, 2021 and 2022. A requirement of being a member of the ICAC Task Force is to report the number of search warrants and arrests made by the affiliates by the 15th of each month. It is a record that is covered by the OPRA.

Thanks so much, Erin. I am attempting to complete a research project on the management of the Cyber-Tips in NJ and would like to be done by December 1, 2023. If you need assistance with locating the numbers I will be in the USA for the next couple of weeks and would be happy to assist you. I made an arrest in February 2019 and the next one was not made until March of 2020 by the OCPO High Tech Crime Unit so just look for my name in InfoShare. Easy Day.
DSG John Dotto made the entries into the ICAC Data System and I believe he still works in the office so perhaps he could show you the numbers. Should not take over 2 weeks.

Received. Have a blessed Thanksgiving. If you need assistance, the records are required to be kept and reported in accordance with the New Jersey Internet Crimes Against Children Task Force Memorandum of Understanding the OCPO signed and agreed to (Page 4 of 6):
"Reporting
By the fifth (5th) day of each month a designee from each participating agency shall report all statistics pertaining to ICAC Investigations, on the attached monthly reporting form, which will be kept on record by the ICAC Commander. All statistics will be combined on a New Jersey Regional ICAC Task Force form and delivered to the ICAC Grant Program Manager at OJJDP. Bi-Annually during the FFY, the ICAC Commander must outline the current project and report on outstanding investigations conducted during this six (6) month period. Each participating agency will highlight those investigations conducted by their investigators and forward them to the ICAC Commander for the Bi-Annual Report."
The ICAC Task Force currently uses the ICAC Data System to report Cyber-Tips, but either source is a record and can be quickly accessed and reported in accordance with the OPRA.

Received. Accuracy, integrity and honesty is very important for criminal justice statistics and I am gratified to see the High Tech Unit is striving for accuracy. I look forward the their public response on or before December 8, 2023. The original respectful request was submitted over a year ago and denied. I am gratified this request which identified the specific records and their locations has assisted you in locating those records.

That was easy. On September 6, 2022, an official response on OCPO letterhead signed by an Assistant Prosecutor specifically stated the OCPO did not have these records. On June 7, 2023, the NJ State Police in response to an OPRA request provided the number of Cyber-Tips sent to the OCPO but in an official document signed by a junior Trooper specifically stated they would not release the arrest numbers because it would cause them to create a record which is not required by the OPRA. Both of those written reports are false as demonstrated in your response. Not a complaint as I know the junior Trooper at the NJ State Police and the junior AP at the OCPO are just doing what they are ordered to do. I would respectfully advise you that sometimes there is a duty to be insubordinate. This would be one of those times.
