Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

This is a request for government records for a former now deceased inmate named Richard Fran Biegenwald. If any requested record is claimed exempt, please treat this as an OPRA request for any non-exempt portions and for reasonably segregable information, and as a request under the common law right of access for any additional disclosure that may be appropriate given the subject is deceased and the strong public-interest/historical research purpose of the request.

Requested records:
1. Copies of any psychological and/or psychiatric evaluation reports of Richard Fran Biegenwald created by NJDOC staff or contractors during 1973 and 1974, including but not limited to:
o the psychiatrist report dated October 1973 referenced by a NJDOC spokesperson, and
o the report dated November 1974 referenced by the same source.
2. Any additional psychological interview notes, testing results, assessment write-ups, classification mental-health summaries, risk/needs assessments, or “clinical summaries” created in 1973–1974 that relate to parole consideration, custody classification, etc
3. Any information, notes, documents, recordings, and transcripts related to Biegenwald's parole hearings in 1970, 1971, 1972, 1973 and 1974.
