Hunterdon County is in receipt of your Open Public Records
Act (OPRA) request 23-1244.

The County Health Department has responded by providing
the attached records which are responsive to your request.

Your OPRA request has been processed and is being provided
with the following redactions:

 

Telephone numbers (N.J.S.A. 47:1A-1.1.) Section 19.

(N.J.S.A. 47:1A-1 [Legislative Findings]) Section 26.
Privacy Interest - “a public agency has a responsibility
and an obligation to safeguard from public access a
citizen's personal information with which it has been
entrusted when disclosure thereof would violate the
citizen's reasonable expectation of privacy.” 

 

Burnett v. Cnty. of Bergen, 198 N.J. 408 (2009). Without
ambiguity, the court held that the privacy provision “is
neither a preface nor a preamble.” Rather, “the very
language expressed in the privacy clause reveals its
substantive nature; it does not offer reasons why OPRA was
adopted, as preambles typically do; instead, it focuses on
the law’s implementation.” “Specifically, it imposes an
obligation on public agencies to protect against
disclosure of personal information which would run
contrary to reasonable privacy interests.”

Information contained in this Open Public Records Act
(“OPRA”) response may include records that are subject to
Legislation recently enacted by Governor Phil Murphy which
protects the home addresses and telephone numbers of
judges, prosecutors, and law enforcement officers from
public disclosure (“Daniel’s Law”). Daniel’s Law amended
OPRA to exclude from the definition of a government record
the portion of any document which discloses the home
address of any active or retired judge, prosecutor or law
enforcement officer. Further, Daniel’s Law prohibits
government agencies, individuals, and businesses from
knowingly publishing on the internet, or otherwise making
available, the home address or unpublished home telephone
number of any active or retired judge or any active or
retired prosecutor. Many of the public records requested
through the County are for property-specific records and
therefore removing home addresses of covered individuals
would not meet the goals of Daniel’s Law. In order to
ensure compliance with the spirit of Daniel’s Law and make
timely disclosure of public records, the County is
redacting all names associated with addresses from its
public records. If you wish to have names included in your
records request, please notify County staff and they can
revise your records. Please note that this revision may
take additional time depending on the size of your records
request and the number of redactions that need to be
reviewed.  

 

Your Open Public Records request has been processed in
accordance with N.J.S.A. 47:1A-1, et seq. If your request
has been denied in whole or in part, the County of
Hunterdon reserves the right to raise any other grounds
for denial not raised in this response. The failure of the
County of Hunterdon to assert an exception or privilege
