Under the Open Public Records Act, a custodian’s response should indicate whether a requested record exists, even if it is exempt from disclosure or no longer retained. Your reply stated that there are “no documents responsive” to my request.

For clarity, could you please confirm which of the following applies in this case:

The requested recordings never existed, meaning no footage was created for this incident;
or

The requested recordings were created but are no longer retained, or are being withheld under a specific exemption (please cite the exemption).

This clarification will help avoid the need for a follow-up request or complaint and will ensure the record-keeping status is accurately understood.
