Re: OPRA Request 26-370
Dear Requestor:
My office is in receipt of your OPRA request dated May 15, 2026, which was received May 18,
2026.
Please be advised that the BWC video (26NB03484) responsive to your request constitutes a
domestic violence record under N.J.S.A. 2C:25-33(a)(7) and so is not subject to release under
OPRA. See N.J.S.A. 47:1A-9(a). In addition, after review of the contents of the responsive
recordings, the video is not releasable under OPRA in light of the City of New Brunswick’s
“responsibility and obligation to safeguard from public access” records which would “violate
[a] citizen’s reasonable expectation of privacy.” N.J.S.A. 47:1A-1; See Burnett v. Cnty. of
Bergen, 198 N.J. 408 (2009).
Thank you for your interest in this matter and if my office can be of any further assistance,
please do not hesitate to contact us.
Sincerely,
Captain
Amish Shah
