RE:     Requests for Public Records Dated August 14, 2020 to the West New
York School District

Dear Mr. Sheridan:

The West New York School District (the “District”) is in receipt of your
request for public records pursuant to the Open Public Records Act
(“OPRA”), N.J.S.A. 47:1A-1, et. seq. dated August 18, 2020. Specifically,
you requested the following records: (1) all purchase requests for HVAC
service for the 2018-2019 and 2019-2020 school years; (2) “as built”
drawings for all HVAC systems district-wide; (3) HVAC System Commissioning
Report; (4) HVAC preventative maintenance schedule district-wide; (5) HVAC
certification of engineer responsible for HVAC system; (6) any purchase
orders for HVAC filters for the past two school years (2018-2019,
2019-2020) until the present day, specifically listing MERV specifications
of the filters; and (7) Superintendent’s Attestation Letter submitted to
the state regarding reopening of schools.

As you may know, Governor Phillip D. Murphy has declared both a public
health emergency and state of emergency pursuant to Executive Order 103,
and has subsequently extended the public health emergency pursuant to
Executive Order 171. Accordingly, the District is currently operating on a
largely remote basis. Gov. Murphy has also recently approved an amendment
to OPRA which extends public entity response deadlines during a state of
emergency and public health emergency. See N.J.S.A. 47:1A-5(i)(2)
(P.L.2020, c.10).

Given the above, the District hereby requests an extension of time in
order to review and respond to your OPRA request. The District shall
provide a response no later than seven (7) business days from the date on
which operations resume. See N.J.S.A. 47:1A-5(i)(2). The District shall
respond in a shorter period of time, if able, but reserves the right to
amend this response and request an additional extension of time as the
circumstances dictate.

right to appeal. OPRA permits a person who believes he or she has been
illegally denied access to a public record to file a complaint with the
GRC, or file suit in Superior Court to challenge the decision and compel
