Dear Pemberton Township Board of Education,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
A copy of the signed the Attestation Letter attesting to the state that the district is safe.
HVAC System Commissioning Report
All purchase requests for HVAC service over the past 2 years
Records requested for each of the following buildings in the school district:
All HVAC Records for the past two years as detailed below for- Pemberton Township High School, Helen Fort Middle School, Emmons Elementary School, Busansky Elementary School, Stackhouse Elementary School, Fort Dix Elementary School, Newcomb Elementary School, Pemberton Early Child Hood Education Center, The New Denbo-Crichton Elementary School, Brother Hood Administration Building, and Little Red School House.
-HVAC certifications and purchase orders showing proof of purchasing the proper merv filters to control and prevent the spread of SARS COV2.
- firm license # and effective dates in NJ
- license # of PE and effective dates and background information of all individuals from the firm working on the contracted efforts in NJ
- if you are aware of any pending legal action and or complaints filed with the department of consumer affairs in NJ or any other state against the firm or the individuals working on the efforts associated with the districts contract
- list of other school districts where similar work has or is being performed
- what is the firms understanding of the ASHRAE COVID-19 recommendations, qualifications?
- can you please provide an explanation of the rationale behind using a sample test in their evaluation for both the # of units and # of class rooms, was this a specific ask of the district or their recommendation? If it was at the districts request what would their recommended approach have been?
- will they include in their report a written statement that the work done was in compliance with the ASHRAE COVID-19 guidance document

While I understand that the HVAC records I have requested may take time to collect and release due to the scope of the request, the copy of the signed letter of attestation for returning to the schools should not be difficult to locate and provide. The request is being processed. Some records that were requested have been placed in storage; which has delayed the response. Please be advised that Governor Murphy recently signed legislation amending OPRA during the COVID-19 crisis. Specifically, the amendment eliminates the 7-day timeline mandated by OPRA during any state of emergency, public health emergency or state of local disaster emergency. It directs records custodians to make a “reasonable effort,” as the circumstances permit, to respond in seven days, or as soon as possible thereafter.
