Holly Gumm v. New Brunswick BOE Settlement Agreements
Dear New Brunswick Board of Education,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
1) copies of any settlement agreements related to the civil case brought against the district by Holly Gumm in NJ Superior Court (MID-L-2720-20), including the 1/24/2026 settlement agreeing to pay for a breach of the previous agreement,
2) copies of all legal bills for the above case,
3) records or statements sufficient to show how much of the aforementioned settlement, and how much of the aforementioned legal bills, were paid by the NB BOE and how much was covered by the MCMJIF and/or other insurers/defendants.

Good afternoon, Mr. Kratovil,
We are in receipt of your OPRA request dated July 23, 2026.
1. See Settlement Agreement & Release entered into between the parties on
or about December 14, 2023 attached. A fully executed copy has been
retained by the Board's insurance counsel on the matter, Kluger
Healey, LLC. The Board is unaware of any breach of the Settlement
Agreement & Release resulting in an additional 01/24/2026 settlement.
2. No legal bills were presented to the New Brunswick Board of Education
for payment. Counsel for the Board was retained through the Board's
liability insurance coverage with the Middlesex County Municipal Joint
Insurance Fund (MCMJIF). The Board has been named as a Defendant in
the matter of Kluger Healey, LLC v. New Brunswick Board of Education
v. Middlesex County Municipal Joint Insurance Fund (MCMJIF), Superior
Court of New Jersey, Middlesex County, Law Division, Docket No.
MID-L-2356-26 in which insurance counsel is seeking payment of its
incurred counsel fees in the matter (see subject bills of Kluger
Healey, LLC dated June 1, 2023, September 5, 2023, January 3, 2024 and
March 20, 2024 attached). The Board has denied responsibility for
payment of these outstanding billings and has asserted a Third Party
Complaint against the Middlesex County Municipal Joint Insurance Fund
(MCMJIF) for same.
3. The New Brunswick Board of Education paid only its deductible to the
MCMJIF. See attached.
