      Re:  Open Public Records Act/Common Law Request
Dear Sir or Madam:
The Borough of Madison received your Open Public Records Act (“OPRA”) and
common law request (“Request”) on March 7, 2024.  The seven business day
deadline to respond to your Request is March 18, 2024. As such, the
Borough is timely responding to your Request in accordance with New Jersey
law.  
Your Request seeks the following:
A list of Madison Borough employees who received compensation and the
amount of stipend or compensation each employee received for health
coverage waiver for the year 2022 and 2023. Please include paystubs as
well showing compensation.
The Borough conducted a good-faith search and identified the enclosed 46
pages of records as responsive to your Request. Please be advised that all
pay deductions have been redacted pursuant to Executive Order 26
(McGreevey 2002). Additionally, social security numbers, bank names and
financial account numbers have also been redacted in order to protect the
individuals’ reasonable expectation of privacy pursuant to N.J.S.A.
47:1A-1 (providing that “a public agency has a responsibility and an
obligation to safeguard from public access a citizen’s personal
information with which it has been entrusted when disclosure thereof would
violate the citizen’s reasonable expectation of privacy); see also
N.J.S.A. 47:1A-1.1 (exempting that portion of any document which discloses
the “social security number” from the definition of a “government
record”); R. 1:38-7 (providing that social security numbers and active
financial account numbers constitute a confidential personal identifier).
See Yoskin v. N.J. Dep’t of Environmental Protection, GRC Complaint No.
 2009-117 (2010) (holding that bank account and routing numbers should be
redacted because “its disclosure may lead to improprieties or theft”).
Lastly, please note that all employee identification numbers and marital
status have been redacted as same constitutes “personnel records” pursuant
to N.J.S.A. 47:1A-10 that are not encompassed within any of the statutory
exceptions that may otherwise allow for public access under particular
circumstances.
Your Request is now deemed answered and closed. Thank you for your
attention to this matter.
