Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

I respectfully request copies of the following government records concerning:

For the period January 1, 2024 through the date this request is fulfilled, please provide:

1. The complete NJDEP file associated with Activity No. 1316-24-0010.1, including all applications, submissions, amendments, supplements, approvals, denials, deficiencies, withdrawals, determinations, permits, verifications, Letters of Interpretation, and related agency records.

2. All site plans, surveys, maps, engineering plans, environmental plans, wetlands delineations, conceptual plans, development plans, and other drawings submitted in connection with the above activity number.

3. All project narratives, cover letters, application forms, certifications, reports, studies, calculations, and supporting documentation describing the proposed development or intended use of the property.

4. All records identifying or describing the proposed single-family homes referenced in NJDEP records, including any records showing:
* number of proposed dwelling units;
* proposed lot configuration;
* location of proposed homes;
* subdivision or development layout; and
* acreage associated with the proposed residential development.

5. All correspondence, including emails and attachments, between NJDEP and the applicant, property owner, attorneys, engineers, consultants, representatives, or agents concerning Activity No. 1316-24-0010.1 or the proposed development at 119 Ely Harmony Road.

6. All records reflecting any change, amendment, modification, withdrawal, replacement, or change in the proposed use of the property from single-family residential development to a cemetery or burial use.

7. All NJDEP records associated with any subsequent permit or application concerning the same property, including any Flood Hazard Area Verification, freshwater wetlands application, Letter of Interpretation, or other land-use approval associated with 119 Ely Harmony Road LLC, Block 108, Lots 14 and/or 17.

8. All records identifying the applicant, property owner, authorized agent, engineer, environmental consultant, attorney, or other representative associated with the applications.
