Dear East Brunswick Police Department,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

This is in response to your Open Public Records Act (OPRA)
request for access to East Brunswick Police Department Records.

Your OPRA request sought access to “All police reports involving
Fred Fenning from 2015 to 2025. Please include DWI and false
reports and or missing firearms.”

Response: Your OPRA request seeking "all police reported" over a
ten-year period is considered a blanket request for a class of
various records/documents rather than for specifically named or
identifiable government records. This request is invalid under
OPRA, and the Custodian has no legal duty to conduct research to
locate potentially responsive records. MAG Entm't, LLC v. Div.
of ABC, 375 N.J. Super. 534 (App. Div. 2005); Bent v. Stafford
Police Dep't, 381 N.J. Super. 30, 37 (App. Div. 2005); NJ
Builders Ass'n v. NJ Council on Affordable Hous., 390 N.J.
Super. 166, 180 (App. Div. 2007); Schuler v. Borough of
Bloomsbury, GRC Complaint No. 2007-151 (February
2009); Abdur-Raheem v. NJ Div. of Criminal Justice, GRC
Complaint No. 2014-171 (June 2015); Feiler-Jampel v. Somerset
Cnty. Prosecutor's Office, GRC Complaint No. 2007-190 (Interim
Order dated March 26, 2008). Based on the foregoing, this
portion of your OPRA request is denied as invalid.

The East Brunswick Police Department reserves the right to raise
any other grounds in support of this response. The failure of
the East Brunswick Police Department to assert any exception,
exemption, or privilege does not act as a waiver of any ground
for denial.
