Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

Records requested:

1. The current signed Government Agency Agreement and Order Form(s) (including any Special Terms per Section 2.11) between Woodbridge Township Police Department and Flock Safety, Inc. for its ALPR camera system.

2. Per Policy 766.6.2, any written agreements to share ALPR data with, or receive it from, agencies outside New Jersey or not covered by AG Directive 2022-12, plus any related State ALPR Coordinator approvals.

3. Any other data-sharing agreements, MOUs, or policies governing which outside agencies (municipal, county, state, or federal) may access the Township's Flock/ALPR network, and whether "National Lookup"/"State Lookup" is enabled.

4. Per Policy 766.7.3, the department's automated stored-data access records for January 1, 2024 to present, including date/time, accessor name, requesting agency, and stated justification for each access — specifically including any access by federal agencies (e.g., ICE, CBP, HSI, FBI, ATF), whether direct or via the Statewide API or another agency.

5. Per Policy 766.9.2, the most recent annual ALPR program audit performed by the Agency ALPR Coordinator, including any documented violations or complaints.

If these exist in a single exportable report (e.g., Flock's audit log/search history export), please provide that in lieu of a custom compilation. If no log exists for the full date range, please provide whatever records currently exist rather than creating a new one.

Dear LOGRANDE, MICHELLE,

I am writing to request reconsideration of the Department's response to my OPRA request, received July 13, 2026, which denied "Document(s)" under a single checked category — "Criminal investigatory records," citing N.J.S.A. 47:1A-1.1 — without indicating which of the numbered items in my request this denial applies to.

My request contained several distinct items, and OPRA requires a custodian who is unable to comply with a request to indicate the specific basis for that determination. N.J.S.A. 47:1A-5(g). As submitted, the response does not indicate whether the denial applies to all items, some of them, or only one, which makes it impossible for me to know what, if anything, has been withheld on a proper legal basis versus what may simply not have been located or reviewed. I ask that the Department clarify which specific item(s) this denial addresses and provide an itemized response to each.

To assist in that review, I want to address why several items in my request do not appear to fit the criminal investigatory records exemption. That exemption applies to a record that (1) is held by a law enforcement agency, (2) pertains to a criminal investigation, and (3) is not required by law to be made, maintained, or kept on file. N.J.S.A. 47:1A-1.1. The following items do not appear to satisfy part (2), as they are administrative or compliance records rather than records tied to any specific criminal investigation:

1. The signed Government Agency Agreement and Order Form between the Department and Flock Safety, Inc. — procurement and contract records. For clarity, the documents I have been able to review to date consist only of Flock's generic, unexecuted template agreement (with blank signature and notice-address fields), not an executed instrument specific to Woodbridge Township. I am specifically requesting the actual signed agreement and Order Form reflecting Woodbridge's negotiated terms, hardware, and pricing — this remains outstanding. To the extent the Department maintains that any specific content within these documents concerning the location, capabilities, or operation of the ALPR system is exempt under N.J.S.A. 47:1A-1.1, I ask that such content be redacted rather than used as a basis to withhold the documents in their entirety, consistent with OPRA's redaction provisions. The core commercial and administrative terms — including the fact and existence of the agreement, pricing, term length, and hardware/product categories — are not location, capability, or operational data and should not be withheld on that basis.

2. Any written agreements under Department Policy 766.6.2 to share ALPR data with, or receive ALPR data from, agencies outside New Jersey or not covered by AG Directive 2022-12. I note that New Jersey's Privacy Protection Act (P.L. 2026, c.4), signed March 25, 2026, explicitly provides that agreements executed for this type of out-of-state ALPR data sharing "shall be considered a governmental record pursuant to... the open public records act."

3. The most recent annual ALPR program audit performed by the Agency ALPR Coordinator under Department Policy 766.9.2 — a compliance document the Department's own policy requires to be created and maintained annually, which weighs against part (3) of the statutory test.

4. The stored ALPR access records maintained under Department Policy 766.7.3. To be clear about the scope of this item: I am not requesting the identity, location, or any personal identifying information of any individual whose license plate was scanned, nor any information tied to a specific investigation or BOLO match. I am requesting only the administrative access log fields the Department's own policy already requires it to maintain — specifically, whether any agency outside Woodbridge PD (particularly an out-of-state or federal agency) queried the system, and the date and stated purpose of that query. This is compliance/audit data about who accessed the system, not investigatory data about who or what was found. Records confirming whether access complied with, or violated, Policy 766.6.2 and the sharing restrictions in New Jersey's Privacy Protection Act are precisely the kind of accountability record intended to be verifiable, and withholding this category entirely — as opposed to redacting any investigation-specific or personally identifying content within it — would allow the exemption to swallow the accountability purpose of the underlying policy.

I ask that the Department issue a corrected, itemized response addressing each numbered item separately, granting access to the records identified above, and citing the specific statutory or policy basis for any item that remains withheld, as required by N.J.S.A. 47:1A-5(g). If any portion of item 1 or item 4 is withheld or redacted, I ask that the Department identify what specifically is being withheld (e.g., location/capability/operational data, or personally identifying information) as distinct from the remaining, non-exempt content, consistent with OPRA's redaction provisions.

Please treat this as a renewed request under my original OPRA submission and respond within the statutory time frame. If the Department maintains its denial of any item, please advise of the specific basis for each so I may evaluate my appeal options under N.J.S.A. 47:1A-6.
