Federal Funding for Main Street Maintenance & Accessibility Improvements

Dear Bradley Beach Borough,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A 6(f), which states that an email from a requester including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
1. All grant agreements, contracts, applications, award letters, scopes of work, or memoranda of understanding related to the $1.4 million in federal funding allocated for Main Street maintenance and accessibility improvements, including any documents describing required municipal responsibilities for maintenance, snow removal, sidewalk upkeep, or ADA-related features.
2. All documents, correspondence, or communications between the Borough and any federal or state agency regarding maintenance obligations tied to this funding, including but not limited to snow removal, sidewalk or paver maintenance, and long-term upkeep of improvements within the Main Street business district.
3. Any Borough ordinances, policies, resolutions, or internal guidance that define or allocate responsibility for snow removal, sidewalk maintenance, or paver replacement within the Main Street business district, especially where federal funds have been used for improvements.
4. Any notices, directives, or internal communications regarding enforcement actions for snow removal or paver replacement in the business district following the acceptance of federal funding.
5. Any engineering plans, project descriptions, or maintenance plans identifying which portions of Main Street were improved or are required to be maintained by the Borough as a condition of receiving federal funds.

Thank you for your response to my prior OPRA request and for providing the award letter.

I am submitting this supplemental OPRA request seeking the following specific government records related to the Transportation Alternatives Set-Aside funding awarded for Improvements to Main Street Streetscape:

A complete copy of the grant application submitted by the Borough, including:
-All proposed scopes of work
-Project narratives
-Budget documents
-Engineering plans or conceptual designs
-Any attachments submitted as part of the application

Any grant agreement, contract, or award package issued by NJDOT or any federal agency following the award letter, including:
-Terms and conditions
-Maintenance obligations
-ADA compliance requirements
-Snow removal, sidewalk, or paver maintenance responsibilities
-Any continuing obligations required as a condition of funding

Any federal or state compliance documents incorporated by reference into this grant, including but not limited to:
-Transportation Alternatives Program requirements
-23 CFR provisions applicable to this award
-ADA/Section 504 compliance requirements
-Any maintenance or long-term stewardship requirements

Any executed agreements between the Borough and NJDOT governing the administration, reimbursement, or maintenance responsibilities for this project.

If the Borough contends it is not the custodian of these records, please identify the specific agency that maintains them.

To Whom it may concern, 
In response to your request, as previously stated, the Borough is not in
possession of any such records. What was sent previously is all that is on
file. To date no improvement projects have started for Main Street and the
Borough does not have any contracts for this project at this time. I would
suggest contacting the Borough Engineer, CME Associates at 732-462-7400
pretaining to the grant application and for further information.
