Dear Fair Lawn Police Department,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Arrest reports related to traffic stops including officer narrative from 01/01/2025 to 01/14/2025.

Please be advised that these records have been redacted as to personal
identifiers, including street addresses, month and date of birth, driver
license numbers and social security numbers pursuant to N.J.S.A. 47:1A-1,
which provides that “a public agency has a responsibility and an
obligation to safeguard from public access a citizen’s personal
information with which it has been entrusted when disclosure thereof would
violate the citizen’s reasonable expectation of privacy.”  Serrano v.
South Brunswick Twp., 358 N.J. Super. 352, 368-69 (App. Div. 2003). 

 

The Borough is also in possession of 3 incident reports related to the
attached CAD reports, however, please be advised that the Incident Reports
are exempt criminal investigatory records.  Specifically, incident reports
are protected from disclosure pursuant to N. Jersey Media Grp., Inc. v.
Twp. of Lyndhurst, 229 N.J. 541 (2017) (the CIR exception applies when the
incident pertains to an investigation into “actual or potential violations
of criminal law”.  Id. at 569 and Paff v. Ocean Cty.  Prosecutor’s Office,
235 N.J. 1 (2018).  Moreover, in Janeczko v. NJ Department of Law & Public
Safety, Division of Criminal Justice, GRC Complaint No. 2002-79 and
2002-80 (affirmed on appeal in May 2004), the Council held that the
exemption does not permit access to the records after the investigation is
closed.
