Your OPRA requested dated December 4, 2017, was received by the Sheriff’s
Office and forwarded to me as Special County Counsel for response. The
response is due no later than December 14, 2017, so this response is
timely.

 

You have asked for a “copy of policies and/or procedures regulating the
Monmouth County Sheriff’s Department public facebook page. The policy may
be found on the website at this address:

also attached to this email.

 

Your second request is for a list of “names of people who are/were hidden,
blocked, banned from the Monmouth County Sheriff’s Department public
facebook page.” Despite the fact that your request lacks specificity and
is therefore overly broad, the  Sheriff’s Office provides this information
that the following accounts have been banned: “Bill Moody” “Jay Hindz”
“Askia Frazier” and “Raritan Hackers.”

 

Your third and fourth requests request the hidden, blocked, banned
comments and the names of the authors of the comments. A list of all posts
that were deleted are attached. However, please not the as of September
2016, the Sheriff’s Office has instituted a policy in which all comments
on the facebook page are automatically hidden. To provide the contents and
authors of those posts would disrupt the normal operations of the
government agency. If you are willing to pay the special fee to obtain
this information, then please advise. Otherwise, you may consider these
requests as denied.

 

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the  to deny access. At your option,
you may either institute a proceeding in the Superior Court of New Jersey
or file a complaint with the Government Records Council (“GRC”) by
completing the Denial of Access Complaint Form.  You may contact the GRC
by toll-free telephone at 866-850-0511, by mail at P.O. Box 819, Trenton,
NJ, 08625, by e-mail at [2][email address], or at their web site at
[3]www.state.nj.us/grc. The Council can also answer other questions about
the law.  All questions regarding complaints filed in Superior Court
should be directed to the Court Clerk in your County.
