Extended civil service list and cause for Atlantic City Police Departmnet
Dear Civil Service Commission,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

Records Act (OPRA) request on February 17, 2025. This response to your
request is being provided to you today.
You made requests for the following documents:
"I would like a list of every civil service extension made in the last 20
years for Atlantic City Police Department and cause for extension."
Our Office emailed you on Friday, February 21, 2025, seeking clarity
regarding your request. However, we have not heard back from you.
Due to the state takeover of Atlantic City, Atlantic City was temporarily
removed from the purview of the Commission and was placed under the
control of a state selected administrator by then Governor Christie in
November of 2016. Governor Murphy then extended that state monitoring in
June 2021. As such, while appointments were made lists do not exist based
on the Municipal Stabilization and Recovery Act during that time. As such,
we need clarification to adequately respond to your request, without which
may lead to the denial of the request.
Please specify a more specific time frame, due to the above and
recognizing that unique nature of the Covid-19 pandemic did affect our
normal processes.
Are you seeking civilian or uniformed titles? As there are 79 titles
within the Department of Public Safety, limiting your title selection may
assist us in expediting your request.
Additionally, while this may not exactly address your inquiry, please note
that the Commission may administratively extend symbols to ensure that
each jurisdiction has a list available when vacancies may occur. Lists may
be extended up to a year but cannot exceed four years to meet that need.
While a list extension may be granted, please note that a current list
will expire with the issuance of a new list. See IMO Public Safety Lists
below. New lists which were tested in Fall of 2024 and Winter of 2025
should issue sometime in Spring-Summer 2025 though a release date has not
yet been announced. Existing lists will remain valid until then. I’ve also
attached the February 2025 Law Enforcement Status Report link below as you
may also find this useful.

Good afternoon, Chris Lodico,
The Civil Service Commission "Commission" received your Open Public
Records Act (OPRA) request on February 17, 2025 and pursuant to our phone
conversation we reopened your request. This response to your request is
being provided to you today.
You made requests for the following documents:
"I would like a list of every civil service extension made in the last 20
years for Atlantic City Police Department and cause for extension."
During the clarification phone call, you also requested to know who the
Atlantic City Appointing Authority is. The appointing authority currently
is the Honorable Marty Smalls, Sr.
To restate what was conveyed during the phone call, administratively the
Civil Service Commission may extend a list to ensure that a valid list is
always available should vacancies arise based on IMO Public Safety lists
which was included in our prior response. That list will expire upon the
issuance of a new list, which you confirmed that you applied and tested
for in 2024 so that release should happen within the next few months. A
list may not, however, exceed four years. You have also confirmed that
Atlantic City previously made appointments from the existing list which
satisfies our requirement of list utilization. Projected or anticipated
retirements are speculative, and the Commission cannot force a
jurisdiction to make additional appointments on this information alone as
a vacancy may not truly exist. As you and your colleagues have expressed
concern about the effective utilization of the list and a delay in the
initial certification, it is recommended that you pursue a possible remedy
through your union representative as that may be a more appropriate
avenue. It should be noted that Atlantic City did make a recent
appointment to the position of Public Safety Director and may also be able
to assist.
The only eligible lists (Atlantic City Police Department) that have been
extended, within the last 20 years, are PM0922S (Lieutenant) and PM0615N
(Sergeant). The comments only include the phrase “extend one year” but do
not include any other information (see attachments).
