The Township of Livingston Clerk's Department is in receipt of your OPRA request. Good afternoon,
This office has received your OPRA request dated March 31, 2023 for "a
search of all files pertaining to 16 East Northfield Road. Especially,
underground storage tanks, environmental concerns, building permits and
ownership records."
In regards to your request for "all files", "environmental concerns" and
"ownership records", these items are overly broad and unclear and do not
identify the records you seek. The Open Public Records Act deals with
requests for readily identifiable public records. The Custodian of Records
is not supposed to perform research to determine which documents exist,
rather to make available  to a requestor a specific record that has been
identified by the requestor. See Bent v. Stafford Police
Department, 381 N.J. Super. 30, 37 (App. Div. 2005); see also MAG
Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J.
Super. 534, (App. Div. 2005) (the municipality does not have to provide
the information sought under OPRA if it fails to identify any specificity
or particularity the governmental records sought and seeks general
information to be analyzed, collated and compiled by the responding
government entity which is not encompassed by OPRA.)
Please see the responsive records provided to us from the Building
Department, which includes any record of underground storage tanks. Any
follow up questions or concerns need to be directed to the Building
Department by emailing [1][email address] . 
Note that a separate email will be sent momentarily to attempt to send one
more responsive file, Permit 21-0495 Installation Plans, as it is too
large to send with the other attachments.
Although you did not identify the ownership records you seek, records of
owners would have to be ascertained through the Essex County Register of
Deeds and Mortgages, by contacting Hon. Juan M Rivera, JR by
emailing [2][email address] or by calling (973) 621-4900. 
Please provide clarification of the environmental records.
