EnviroSure is completing a Phase I ESA at a nearby property. In that regard, we are requesting
a search of all files pertaining to 13-19 East Northfield Road and 25 East Northfield Road, Livingston Township, Essex County, NJ. Especially, underground storage tanks,
environmental concerns, building permits and ownership records.

The Township of Livingston Clerk's Department is in receipt of your OPRA request. Pursuant to NJSA 47:1A-5(i), you shall receive a response in no more than seven (7) business days, with day one starting the day after the request has been received. This office has received your resubmitted OPRA request dated April 5, 2023
for "a search of all files pertaining to 13-19 East Northfield Road and 25
East Northfield Road, Livingston Township, Essex County, NJ. Especially,
underground storage tanks, environmental concerns, building permits and
ownership records."
In regards to your request for "all files", it was explained in our
previous email that this is overly broad and unclear and does not identify
the records you seek. Your revised request for records of "environmental
concerns" and "ownership records" is also overly broad and unclear. The
Open Public Records Act deals with requests for readily identifiable
public records. The Custodian of Records is not supposed to perform
research to determine which documents exist, rather to make available to
a requestor a specific record that has been identified by the
requestor. See Bent v. Stafford Police Department, 381 N.J. Super. 30, 37
(App. Div. 2005); see also MAG Entertainment, LLC v. Division of Alcoholic
Beverage Control, 375 N.J. Super. 534, (App. Div. 2005) (the municipality
does not have to provide the information sought under OPRA if it fails to
identify any specificity or particularity the governmental records sought
and seeks general information to be analyzed, collated and compiled by the
responding government entity which is not encompassed by OPRA.)
Furthermore, there is no address on record in the Township of Livingston
for 13-19 E Northfield Rd.
In regards to 25 E Northfield Rd, please see the responsive records
provided to us from the Building Department, which includes any record of
underground storage tanks. Any follow up questions or concerns need to be
directed to the Building Department by

Although you did not identify the ownership records you seek, records of
owners would have to be ascertained through the Essex County Register of
Deeds and Mortgages, by contacting Hon. Juan M Rivera, JR by

Please provide clarification of the environmental records and addresses
you seek.
