Enrollment & CHPE opt-outs; book challenges & legal invoices (SY 2024–2026)
Dear Medford Township School District Records Custodian,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
School years: Please treat “school year” as the District’s standard school-year boundaries, and provide records for SY 2024-2025 and SY 2025-2026.
1) Any document(s) stating total student enrollment by grade for each listed school year.
2) CHPE / Health curriculum opt-outs (aggregate counts only)
Any document(s) showing the number of students opted out (in whole or in part) pursuant to N.J.S.A. 18A:35-4.7 for each listed school year, broken out by grade level; aggregate counts only (please redact any student-identifying information if present).
3) Parent opt-out / opt-in form(s)
Copies of the form(s) used in each listed school year for parents/guardians to opt out / opt in (or otherwise exercise rights under N.J.S.A. 18A:35-4.7) for CHPE/Health instruction.
4) Implementation communications (final versions)
Parent/guardian communications used to implement the opt-out process in each listed school year (e.g., emails, flyers, handbook pages, website postings, portal messages).
5) BOE policies: book review/removal and committee composition
Current BOE policy(ies) and regulation(s) governing book review/reconsideration/removal requests and the composition/operation of any book review committee (or equivalent).
6) Book review/removal/reconsideration requests (7/1/2024–present)
Copies of requests submitted seeking review/restriction/removal of books from curriculum and/or school libraries from July 1, 2024 to present, plus final determinations/resolutions; redact any student-identifying information.
7) Legal invoices (7/1/2024–present)
Copies of legal invoices/bills submitted by the Board Attorney and any outside counsel from July 1, 2024 to present.
Format: Please provide all responsive records electronically via email attachments (PDF preferred). If any portion is withheld or redacted, please identify the specific legal basis for each withholding/redaction.
Please confirm receipt. If you are not the custodian for any portion, please forward to the appropriate custodian and advise me of that custodian’s contact information.

Dear Medford Township School District,
I am writing to request an internal review of the District's handling of my OPRA request "Enrollment & CHPE opt-outs; book challenges & legal invoices (SY 2024–2026)."
Item #6 of my request has not been addressed. Item #6 requested:
"Book review/removal/reconsideration requests (7/1/2024–present): Copies of requests submitted seeking review/restriction/removal of books from curriculum and/or school libraries from July 1, 2024 to present, plus final determinations/resolutions; redact any student-identifying information."
In the District's initial response dated March 2, 2026, the Records Custodian explicitly committed to producing this item, stating: "any documents responsive to number 6 of your request, along with the balance of number 7, will be provided within the next seven business days, by March 11, 2026."
The District's follow-up response dated March 11, 2026 provided only the balance of Item #7 (redacted legal invoices). No documents responsive to Item #6 were produced, no denial with a specific legal basis was issued, and no certification that no responsive records exist was provided. Item #6 was not mentioned.
Under N.J.S.A. 47:1A-5, a custodian must grant access, deny access with a specific legal basis, or certify that no responsive records exist. None of these actions have been taken for Item #6, despite the custodian's own written commitment to produce responsive documents by March 11, 2026.
I respectfully request that the District produce any records responsive to Item #6, deny access with a specific legal basis, or certify that no responsive records exist.
