Wendi Seelin,

Dear Matthew Operations:
The Borough is continuing to process your Open Public Records Act request.
Additional time is required to locate, gather, and review the potentially
responsive documents from the appropriate departments.
Accordingly, the Borough is requesting an additional fourteen days,
through August 5, 2026, to complete its search and provide a response to
your request.
Please confirm your agreement to this extension in writing. The Borough
will continue working on the request and will provide the responsive
records sooner if they become available before the extended deadline.
Thank you for your cooperation.

Dear Wendi Seelin,

14 days for simple records is excessive for such a simple request. 5 business day extension should suffice

Yours sincerely,

Matthew Operations

Wendi Seelin,

Dear Matthew Operations:
The Borough acknowledges your objection to the requested extension.
The extension through August 5, 2026, remains necessary because the
employee responsible for locating and gathering the potentially responsive
records is currently on scheduled leave. In addition, the Borough must
conduct a complete search of the appropriate departments and review any
potentially responsive records to determine whether they are subject to
disclosure or exempt under OPRA.
Although you have characterized the request as simple, the Borough is
required to conduct a complete and accurate search and cannot provide
records before that process is completed.
Pursuant to N.J.S.A. 47:1A-5(i)(1), a records custodian is entitled to a
reasonable extension when unforeseen circumstances or other circumstances
reasonably necessitate additional time to fulfill a request. The statute
requires the Borough to provide written notice of the extension and an
anticipated response date; it does not require the requester’s agreement
to the extension.
Accordingly, the Borough’s anticipated response date remains August 5,
2026. The Borough will continue processing the request and will provide
its final response sooner if the review is completed before that date.
Thank you.
