I actually viewed and read the documents very carefully. I still don't see the documents for #2 though. I didn't request YTD earnings documents for the month of January 2019 that you provided to me. I'm seeking payroll record(s) broken down by pay period(s). Sorry for the confusion.

Please be advised that this office provided you with a response to
OPRA#46-19 for the 2018 year-end payroll for all municipal employees of
the Town of Guttenberg, which included name, title, salary and length of
service of each employee. Additionally, we also provided you with a
response to your second request, Question #2, January 2019 payroll
record(s) for each employee of the municipality.
With regard to our most recent conversation, wherein you indicated you
were not satisfied with the response, after further review and
consultation with the Payroll Department, I’ve been informed that the
documents that were provided were actually documents that were created by
the Payroll Department from an outside source (Payroll Firm).
I bring your attention to N.J.S.A. 47:1A-9
Creating A Record – exemption N.J.S.A. 47:1A-9; GRC Exemption No. 23
[State or federal statutes and regulations, Executive orders, etc.]
• Pursuant to the definition of a Government Record, a State Agency
does not have to provide a record that does not exist or create a
record in response to requests. This was recognized by the court
in Mag Entertainment, LLC v. Division of Alcoholic Beverage Control,
375 N.J. Super 537 (App. Div. March 2005).
Since the initial documents were inadvertently created without my
knowledge and there is no other document relative to your request
maintained by this office, your request is denied pursuant to
N.J.S.A. 47:1A-9; GRC Exemption No. 23.
