Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:
- Current union contract that covers all of public safety
- Current annual salary for Craig Hertenstein
- The type and amount of time off Craig Hertenstein has used from April-June 2026.
- Disciplinary records for Craig Hertenstein involving any demotions/gross misconduct incidents. I am specifically looking for an incident from January/February of 2014 where Craig Hertenstein was caught driving a state-owned vehicle while intoxicated. If you are unable to provide me with the actual disciplinary records, I am requesting the actual documented report from the Public Safety department.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

I am also requesting these documents under Common Law:
The requested records concern the expenditure of public funds, the compensation of a public employee, the use of paid leave and work time, the terms and conditions of employment for public safety personnel, and disciplinary actions taken in connection with the performance of official duties.

Under the common-law right of access to public records, records maintained by a governmental entity are presumptively open when they document the conduct of public business and disclosure serves the public interest. The public has a legitimate interest in evaluating how government employees perform their duties, how public agencies respond to misconduct, how public funds are spent on salaries and benefits, and whether disciplinary actions are administered consistently and appropriately.

The requested union contract, pay records, and time-use records directly relate to the expenditure of public funds and the administration of public employment. Likewise, records concerning disciplinary actions, demotions, and incidents involving alleged on-duty misconduct and operation of government vehicles concern the conduct of official government business and the agency's exercise of its supervisory and disciplinary authority. Disclosure of these records promotes transparency, accountability, and public oversight of government operations.

To the extent any portion of a requested record is claimed to be exempt from disclosure, I request that any reasonably segregable non-exempt portions be produced and that the specific legal basis for each withholding or redaction be identified.
