Please be advised OPRA is not intended as a research tool to force
government officials to identify and siphon useful information. Rather,
OPRA operates to make identifiable government records readily accessible
for inspection, copying or examination. OPRA does not countenance
open-ended searches of an agency’s files. MAG Entertainment, LLC v.
Division of Alcoholic Beverage Control, 375 N.J. Super. 534, 549 (App.
Div. 2005)

A requestor must specifically describe the document sought. Bent v.
Stafford Police Department, 381 N.J. Super. 30, 37 (App. Div. 2005). “As
such, a proper request under OPRA must identify with reasonable clarity
those documents that are desired, and a party cannot satisfy this
requirement by simply requesting all of an agency's documents.” Currently,
your request for "any and all real estate transactions the Borough of
Seaside Park has purchased or sold in the last 8 years" fails to identify
with reasonable clarity the specific government records sought, as is
required by Bent v. Stafford Police Department, 381 N.J.Super. 30, 37
(App. Div. 2005). You have failed to specify a particular document. Please
clarify your request, stating with particularity the specific documents
sought.

Dear Requestor,

The Borough of Seaside Park received your request on August 30, 2022 for:

On September 7, 2022, the Records Custodian responded that there were no
responsive documents to your request for "a list regarding Seaside Park
eminent domain properties such as purchases, court actions, code/property
violation etc. for the last 8 year" and requested clarification for "any
and all real estate transactions the Borough of Seaside Park has purchased
or sold in the last 8 years." On September 16, 2022, the Records Custodian
followed up when no response was received.

Because no response was received from either clarification request sent,
this OPRA request is now closed. Please submit a new OPRA request
specifically identifying the records sought. Thank you!
