Emergency services personnell ID programme
Dear Bergen County,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
records, documents, and files kept by your county and agencies regarding your first responder identification card programme from January 1, 2013 until the December 31, 2023.
please send a list of all ID cards issued, the document number, card, id or badge number, first, middle, and last name of the person it was issued to, date of issuance, date(s) of renewal, their title(s), department, and details kept by your county and program excepting those details that are excluded by the records law; any application forms; documents generated in the process of issuing an ID; photographs along with name, date, title, and department; the file(s) (paper or electronic) kept on each person issued an ID; the profile of each person issued an ID; name, badge/PIN/ID number, rank/title, status, etc., demographic information about the gender and race/ethnicity, Salary history, performance reviews or information, benefits information such as leave balances and usage dates, date of hire of each person if available for each person issued an ID any emails, letters, correspondences, contracts, agreements, or other written communications from January 1, 2013 until the December 31, 2023.

Please be advised that the majority of the information sought in your request is not maintained by the County of Bergen and you will have to request it from each municipality individually. Our system is only able to provide the following:
1. Name of personnel – Last name, First name
2. Occupation
3. Status – Active, Inactive, Retired, Lost/Stolen
Pictures will not be provided as they are exempt from disclosure pursuant to N.J.S.A. 47:1A-1 as a reasonable expectation of privacy and N.J.S.A. 47:1A-1.1 as security measures which, if disclosed, would create a risk to the safety of persons, and Daniel's Law.
Please advise as to whether you would like our vendor to run a report with the 3 available fields identified above. If the above is sufficient, the County will need additional time to answer your request as it entails several years of information and should be able to provide same on or before October 18, 2024.

A report is being generated for county employees and will be released when
received but no later than October 18, 2024. As stated previously, you
will need to make separate requests need to each individual municipality
in regards to their employees.

records, documents, and files kept by your county and agencies regarding your first responder identification card programme from January 1, 2013 until the December 31, 2023: This portion of your request cannot be answered as it is overly broad and fails to specify a readily identifiable record as is required by OPRA. MAG v. Division of ABC, 375 N.J. Super. 534. (App. Div. 2005).

In addition, you have been advised that the attached reports only apply to County employees and that you would have to contact each municipality directly in regards to their employees. Lastly, photographs will not be released as they are exempt from disclosure as a security risk, a reasonable expectation of privacy and potential Daniel's Law violations pursuant to N.J.S.A. 47:1A-1, N.J.S.A. 47:1A-1.1, and P.L. 2021, c.371 (A6171 2R CC). In addition, N.J.S.A. 47:1A-10 provides that a requestor is only entitled to the following information an individual's name, title, position, salary, payroll record, length of service, date of separation and the reason therefor, and the amount and type of any pension received and does not include ID numbers, etc.
Salary history, performance reviews or information, benefits information such as leave balances and usage dates, date of hire of each person if available for each person issued an ID: Attached please find County employee salary spreadsheet for all County employees providing salary, title, date of hire. However, you only requested this documentation from our ID system, which does not exist. Despite same, you were provided with a spreadsheet from our payroll division for the year of 2024 as no document exists isolating only ID holders. Please be advised that all personnel records are exempt from disclosure pursuant to N.J.S.A. 47:1A-1.1 other than the following information: an individual's name, title, position, salary, payroll record, length of service, date of separation and the reason therefor, and the amount and type of any pension received. As such, performance reviews, and benefits information will not be provided. In addition, the County is not required to create a document responsive to your request.
