Good afternoon Mr. Arcoleo,
Pursuant to legal counsel, the OPRA request included in the attached PDF
must be refined to include the following specifications:
• Date/time range for the search.
• Sender/Recipients names (the words “Engineering firms” and
“representatives of Catalyst Experiential” are overbroad)
• Keywords besides the Block and Lot to enable additional search
criteria, if desired.
A proper request under OPRA must identify with reasonable clarity those
documents sought. A custodian is obligated to search and a find the
identifiable government records listed in the Complainant’s OPRA request.
A custodian is not required to perform research of their files to figure
out which records, if any, might be responsive to an overbroad and/or
unclear OPRA request. See MAG Entertainment, LLC v. Division of Alcoholic
Beverage Control, 375 N.J.Super. 534 (App. Div. 2005). Any OPRA requests
for emails must contain three (3) characteristics pursuant to Elcavage v.
West Milford Township (Passaic), GRC Complaint No. 2009-08 (April 2010),
as follows: 1. Specific subject or keywords to be searched; 2. Specific
date or range of dates; 3. Sender and/or recipient. The GRC has also
applied the criteria set forth in Elcavage, to other forms of
correspondence, such as letters. See Armenti v. Robbinsville Bd. of Educ.
(Mercer), GRC Complaint No. 2009-154 (Interim Order May 24, 2011). Please
clarify your request as indicated above.
