In fulfillment of your substantial OPRA request dated March 2, 2021; the
Borough must retain the services of its IT administrator to facilitate
same. An estimate for the work necessary falls within the range of $300 to
$1200. Accordingly, the Borough will require you to post an escrow in the
amount of $750 to begin the work necessary. You will be refunded any
escrow monies not used; however you will be required to replenish the
escrow should the work needed by the IT administrator exceed the funds
posted.  You can post escrows in the form of a check or money order.
Kindly inform me on when you will be submitting such funds so that we can
proceed.

I had trouble with doing a reply in Opramachine. Could you answer a few questions about your response?

Has this been the policy all along? My first request did not come with a demand for payment. I am not looking for any research to be done, I am asking for all the emails and I don't understand what this requires different than the last.

If I decide to make a payment, can you tell me the rate per hour I am being charged? If I request emails from a specific date range, would the charge still apply. If I request a specific topic and only those emails under that topic do the charge atill apply. If I provide the specifics of the document I am looking for and the date range would the charges still apply? Would it make a difference if this was a newspaper asking for this information? Would the charge still apply if this was for a lawsuit?

Dear Bonnie W., 

It is the policy of the Borough that incurred outside costs on an OPRA
request are the responsibility of the requestor.  

Your previous request was limited in scope, adhering to a current
two-month time frame, so, while time consuming, the fulfillment was able
to be done in house.  Your present request is asking for emails that start
a year ago, and we do not have the ability and need the assistance from
the IT company to fulfill same.   

In response to the charges, the Borough will be billed the minimum charge
of $280 and the hourly charge is $120.00.   

Regarding requesting a specific topic request, the IT company can only
perform a date range search, not topic. Unless you specify a specific date
for a topic, reviewing emails for a topic within a time range can be
considered research. The same response would apply for specifics of a
document. 

Advising you of the costs for the OPRA is not specific to your request, it
would also apply to a newspaper or if it was requested by a lawyer for a
lawsuit.

Good afternoon,
Unless I know what you are looking for and the date range I cannot give
you a definitive answer.  If you supply me with what specifically you are
looking for and date range I will see if I can pull the document(s)
without having to get assistance from the IT company.
Regarding the other OPRA request you have mentioned.  While they are
similar to what you have requested, they are for different people and
would require separate searches for each, therefore the same response you
received, they also received.  As of this email there has been no response
received from those requestors, so a search has not yet been conducted for
either.

Good morning,
I am in receipt of the amendment of your request.  Yesterday I made
multiple attempts to manually scroll back to the time that you are
requesting.  Unfortunately I am unable to do it manually.  To fulfill the
requested time the IT Company would need to do the search and download. 
Due to a smaller time span, the process would be completed more quickly,
and the cost would be on the lower end of the costs quoted in a prior
email.
Please advise how you wish to move forward.
