As custodian of records for the East Windsor Regional Board of Education
(“Board” and/or “District”), I am writing this letter in response to your
request for records pursuant to the Open Public Records Act (“OPRA”)
submitted via email at 12:55 pm on Friday, January 24, 2025.

 

More specifically, your OPRA request seeks access to the following:

 

“All correspondence from and to Christina Lands of the East Windsor
Regional School District Board of Education that include the words "New
Jersey Project," "NJ Project," "NJ Fresh Faced Schools," "Parent
Recommended School Board," or "Nik Stouffer.".”

 

This request is overly broad in that the request does not identify
specific records nor a reasonable time period for the search. A proper
OPRA request must identify with reasonable clarity by specifically
describing those documents that are being sought. See Gannett New Jersey
Partners L.P. v. County of Middlesex, 379 N.J. Super. 205, 211-12, 877
A.2d 330 (App. Div. 2005); New Jersey Builders Association v. New Jersey
Council on Affordable Housing, 390 N.J. Super. 166, 178 (App. Div.),
certify. Denied, 190 N.J. 394 (2007); Bent v. Stafford Police Dep’t,
381 N.J. Super. 30, 40 (App. Div. 2005). Under OPRA, one cannot submit
“wholesale requests for general information to be analyzed, collated and
compiled by the responding government entity.” MAG Entertainment, LLC v.
Division of Alcoholic Beverage Control, 375 N.J. Super. 534, 868 A.2d 1067
(App. Div. 2005).  (The Court found a request for “all books, records,
[and] documents” related to a specific project to be improper.) 

 

Additionally, in accord with MAG, supra, and its progeny, in order to
specifically identify correspondence, OPRA requests must contain the
following characteristics: content and/or subject; specific date or range
of dates; and, sender and/or recipient.  See Elcavage v. West Milford Twp.
(Passaic), GRC Complaint No. 2009-07 (April 2010); Armenti v. Robbinsville
Bd. of Educ. (Mercer), GRC Complaint No. 2009-154 (Interim Order dated May
24, 2011); Sandoval v. NJ State Parole Board, GRC Complaint No. 2006-167
(October 2008) and Schuler v. Borough of Bloomsbury, GRC Complaint No.
2007-151 (February 2009). Further, pursuant to N.J.S.A. 47:1A-5, a
custodian is not required to fulfill a request for correspondence,
including emails, “if the request does not identify a specific job title
or accounts to be searched, a specific subject matter, and is not confined
to a reasonable time period”. Accordingly, as submitted, your request is
overbroad in nature, does not include all of the required criteria and is
thus invalid pursuant to the OPRA.

 

In lieu of issuing a denial of your request, please clarify the following:

 1.  A reasonable time period for the search. 
 2. The specific documents to be searched.

 

In the event that we do not receive the above required information within
seven (7) days, this correspondence shall represent the Board’s denial of
your request as overbroad and for failure to provide the information as
required per N.J.S.A. 47:1A-5. As such, this correspondence and the above
information shall constitute a full and complete response to your OPRA
request and therefore, your OPRA request will be deemed closed.
