With respect to your above-referenced request under the Open Public
Records Act (“OPRA”), please be advised that the County of Passaic
(“County”) is unable to provide you with the requested information. Under
OPRA, a records request must be well-defined so that the records custodian
knows precisely what records are sought, and should not require the
custodian to undertake any subjective analysis to understand the nature of
the request. Paff v. Galloway Twp., 229 N.J. 340, 355, (2017). In this
instance, it is unclear what records and/or information you are seeking,
so the County is unable to finish processing your request.
 
Even if it were clear what metadata you are seeking, pursuant to recent
amendments to OPRA, metadata (including SMTP header properties of emails)
is generally confidential and undisclosable under OPRA, with minimal
exceptions. N.J.S.A. 47:1A-1.1. Nor does OPRA does not permit requests
that “would require research and the collection of information from the
contents of government records and the creation of new government records
setting forth that research and information.” N.J.S.A. 47:1A-5(g).
Accordingly, your request also cannot be processed to the extent that it
would require the County to either disclose confidential metadata or
compile disclosable metadata into a new record.
 
This response does not waive or limit any rights afforded to the County of
Passaic under OPRA. All rights afforded under OPRA are expressly reserved.
