Email Logs for John Peros, the now Former Wandell Board President

Response to this request is long overdue. By law, under all circumstances, Saddle River School Distict should have responded by now (details). You can complain by requesting an internal review.

Dear Saddle River School District,

This is a request for public records made under OPRA and the common law right of access. Under the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), and in light of the precedent set by the New Jersey Supreme Court in Paff v. Galloway Tp., I am requesting access to and copies of specific email metadata from the Saddle River Board of Education (BOE).

I seek a log of emails where John Peros, the now Former Wandell Board President, is either the "sender" or "recipient." This request specifically targets the following email metadata fields to include "sender" "recipient" "date" and "subject"

The time frame for this request covers the period from June 28, 2023, to the present.

** Please be sure to only return as a PDF file. **

In alignment with the ruling in Paff v. Galloway Tp., this request is for the metadata fields of the emails and not the content of the emails themselves. The email metadata should encompass all emails sent to or received by Mr. Peros during the specified period, irrespective of whether these emails have since been deleted.

Common Law: Under common law, I seek access to the requested documents to ensure transparency and accountability in the spending of public funds by the Saddle River School District.

(1) To the extent that any such records contain personally identifiable information related to any individual student, please redact that personally identifiable information prior to disclosure.
(2) To the extent that any such records are exempted from disclosure under OPRA, and also unavailable under the common law right of access, please provide a complete Vaughn index of all such records, disclosing “sufficient detail to prove the requestor ‘with as much information as possible to use in presenting his case’ and to enable the ‘decision-maker’s review of governmental records to determine whether they contain privileged material.’” Paff v. Division of Law, 412 N.J. Super. 140, 161 (App. Div. 2010).

Regards,
Brian Hampel
