Email logs for Dr. Eric Hibbs
Dear Marlboro Board of Education,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Dear Marlboro Board of Education
I am requesting copies of email logs for Superintendent Dr. Eric Hibbs for:
Mar 1- 13, 2022
April 1-8, 2022
August 4-10, 2022
Please include sender, recipient, date and subject."
Please see the Paff v. Township of Galloway Supreme Court decision from 2017, which held this is a valid OPRA request.
Please send your response in PDF form.
Yours faithfully,
ANON
Good Morning,
We have received your request on 9/23/22. Please allow us seven
business days to respond.
Thank you,
Vincent
Good Afternoon,
We are requiring a 30 day extension for your OPRA request due to the
volume of requests and district workload.
Thank you,
Vincent
Dear Vincent Caravello,
Thank you for your response, however I am quite confused on the 30 day extension request as it's just a matter of your IT department pulling email logs from your server. There should be no manual processes behind it as it's a simple report and noticed you responded immediately to another OPRA request for videos, which does take manual work.
If you need a few more days as you stated because you are backed up, I can understand, but to push this out to next month does not make sense. Please clarify why this will take longer.
Yours sincerely,
J. Mull
Good Afternoon,
I clarified due to workload and the amount of other requests needing to be handled. We will respond within 30 days.
Thank you,
Vincent

Good Afternoon,
Please see attached the letter associated with your request. OPRA permits
governmental agencies to impose special service charges whenever the
nature, format, manner of collation, or volume of a government record
embodied in the form of printed matter to be inspected, examined, or
copied pursuant to this section is such that the record cannot be
reproduced by ordinary document copying equipment in ordinary business
size or when fulfilling a request requires an extraordinary expenditure of
time and effort. See N.J.S.A. 47:1A-5(c).
Please let us know if you wish to proceed with the special service charge
to process this OPRA request.
Thank you,
Vincent
Dear Vincent Caravello,
Thank you for your letter but based on your response, I believe there might be a miscommunication here and want to ensure we are on the same page:
Here is a sample log I am looking for: https://opramachine.com/request/copies_o...
The above OPRA request was asked from our township police chief, who manages 40,000 residents on a daily basis, while Dr. Hibbs oversees a school district of 5-6k students. Within several days the logs were sent to the requestor and am not sure what is more complicated about my request as I am only looking for same information and perhaps should have been more specific in the email account since you are stating that over 5000 emails were logged in over those three time periods.
To be clear I want to see the email log for [email address]. Not sure why our police department can provide this with no additional cost, but a substantial charge is being asked from our BOE administration from a private citizen... Perhaps this clarified things and looking forward to the information...
Yours sincerely,
J. Mull
I will be out of the office from November 10th thru November 15th.
I will have no access to email and I will get back to you as soon as I
return.
Thank you,
Vincent Caravello

Dear Mr. Caravello,
I hope you enjoyed your PTO with your family, however, I am following up as you promised to get back to me upon your return on 11-16-22 with no response to date.
To be clear, I was not requesting to see every individual email sent to and from [email address], during the requested times, but just a simple email log with the following as per request on 9.23.2022. Once again here was my original request:
Dear Marlboro Board of Education,
I am requesting copies of email logs for Superintendent Dr.
Once again, a similar request was made to the Marlboro Police Department where the administrator was able to provide the information very quickly without delaying it for 30 days nor asking for additional fees.. https://opramachine.com/request/copies_o...
Please let me know if you need additional clarification and confirm I can receive this information by COB by Tuesday.
Best,
J. Mull
Mr. Mull,
We understand you were not seeking the emails themselves. We stand by our
initial response.
Thank you,
Vincent
Dear Vincent Caravello,
You haven't provided me any clarification on why my request varies from a similar request to the chief of police in February of 2019 and the cost you are requesting:
https://opramachine.com/request/copies_o...
As per Paff v. Township of Galloway Supreme Court decision from 2017 the information I am requesting is not confidential as I am only looking for sender, recipient, date and subject which does not disclose confidential material. If you need to refer to the judgement here it is:

Looking forward to your prompt response and have a great Thanksgiving....
Yours sincerely,
J. Mull
Dear Vincent Caravello,
This is my final request for clarification on my response below and if I don't receive a response by 12-9-22, you will leave me no option but to file a request to NJ GRC for failure to provide information:
You haven't provided me any clarification on why my request varies from a similar request to the chief of Marlboro police in February of 2019 and the exurbanite estimated cost you are requesting:
https://opramachine.com/request/copies_o...
The only possible difference is redacting names in subject lines.
As per Paff v. Township of Galloway Supreme Court decision from 2017 the information I am requesting is not confidential as I am only looking for sender, recipient, date and subject which does not disclose confidential material. If you need to refer to the judgement here it is:
https://caselaw.findlaw.com/nj-supreme-c...
Yours sincerely,
J. Mull
