Your request for A log of sent and received emails for Email log of Karen Stallings from August 1, 2024 through August 19, 2024 including the TO, FROM, SUBJECT, DATE, TIME and COPIED INDIVIDUALS contains in excess 950 Line Items required to be reviewed for redaction pursuant to N.J.S.A. 47:1A-1, N.J.S.A. 47:1A-10 and N.J.S.A. 47:1A-1.1 -9 (privacy, personnel, attorney client privilege). The Township of Berkeley does not have an employee dedicated to only public requests .
It will take the custodian approximately one minute per line item to review each and redact accordingly translating into approximately 950 minutes or 15.83 Hours. The Township would require a Special service charge 15.83 x $ 19.82 per hour at a cost of approximately $313.75. The $19.82 per hour constitutes the lowest paid person in the Clerk’s office even though that person cannot do the work because of the confidentiality aspect of the email log the real cost is $64.54 x $15.83 hours for the person who actually do the work costing $1021.67.
At this time the Township does not have onsite IT personnel the Township will also require the cost of the IT Company Coastal Solutions to run the log report it will take them approximately 1/2 an hour to run the report at $135.00 per hour costing $67.50 . The Total cost for the Township to provide the log is $381.25
The Township will require a deposit of $190.63 to begin processing your request. Approximately half of the total cost. Once the Township receives the deposit payment we will require 14 business days to complete the request. You will be notified when the Log is completed and the remaining amount will be required to be paid before the document is released
Township Administration will track the actual time taken to produce the documents.
The Township will assume that you do not want to continue with your request if the Township does not receive your payment within Seven business days of this notice, by September 5, 2024.
If you notify us with an intent to pay you must provide a date(within a 10 day time period) we will have the payment by if we do not have the payment by the date you provide we will consider the matter closed.
Payment can be made either
1. In person Monday through Friday Between 8:30 and 4 pm cash(exact change), check or money order 2. Via Mail : Berkeley Township Clerk’s Office, P.O. Box B, Bayville NJ 08721 - Check or Money Order Because the request was made anonymously please provide a copy of the request or this email so we can insure we are releasing the correct documents to the correct requestor If a copy of the request is not provided your payment will be returned and the documents will not be provided until your payment is accompanied by the request you made.
Dear Karen Stallings,
I am in receipt of your response and I am quite taken aback. I have requested email logs for a lot longer period of time from different prosecutor's office's and have never once received a bill for the logs. Your breakdown doesn't really seem to justify that amount and I am curious how many people actually pay that type of fee or if this tactic deters them. If this is your stance I may need to resubmit my request another way. Thank you for your time.
