Please accept this email on behalf of Sussex County.

 

The County is in receipt of your OPRA request for the following:

 

 1. The names, job titles, and departments of all county employees,
contractors, or consultants who had [1]@sussex.nj.us email accounts on
November 3, 2025.

 

 2. When each email account was created, and if any have been deleted or
turned off.

 

 3. Any shared accounts or group addresses used for cybersecurity, IT, or
county-wide emails (like helpdesk@, alerts@, ccarney@, security@,
etc.).

 

Your request is denied.  As to item 1 there are no documents responsive to
your request.   Please see Pusterhofer v. N.J. Dep’t of Educ., GRC
Complaint No. 2005-49 (July 2005): The Council determined that no unlawful
denial of access occurred because the custodian certified that no
responsive records existed and there was no evidence in the record to
refute her certification. See also Pavlenko v. Twp. of Delran
(Burlington), GRC Complaint No. 2010-325 (March 2012).

As to items 2 and 3 are denied as they are a request for information not a
government document. . Please see; Bent v. Stafford Police Dep’t, 381 N.J.
Super. 30 (App. Div. 2005): The Court affirmed the GRC’s decision (GRC
Complaint No. 2004-78) that the complainant’s request was broad and
unclear (“any and all”). The Council ruled that the information sought did
not amount to an identifiable government record. And  MAG Entm’t, LLC v.
Div. of Alcohol Beverage Control, 375 N.J. Super. 534 (App. Div. 2005):
The Court held that “[w]hile OPRA provides an alternative means of access
to government documents not otherwise exempted from its reach, it is not
intended as a research tool litigants may use to force government
officials to identify and siphon useful information. Rather, OPRA simply
operates to make identifiable government records ‘readily accessible for
inspection, copying, or examination.’ N.J.S.A. 47:1A-1.” (emphasis added).
The Court further held that “[u]nder OPRA, agencies are required to
disclose only ‘identifiable’ government records not otherwise exempt . . .
In short, OPRA does not countenance open-ended searches of an agency's
files.” Id. at 549 (emphasis added). These are also denied under the
security exemption specifically allowed under the statute. Administrative
or technical information regarding computer hardware, software and
networks which, if disclosed would jeopardize computer security. N.J.S.A.
47:1A-1.1 (10).

 

Also, as of September 3, 2024, the OPRA laws were amended. The new
amendments prohibit a party to a legal proceeding from filing an OPRA
request, if the records sought are the subject of a court order or pending
discovery request. It is our good faith belief that this request is in
fact being made by a party to a current legal proceeding. Therefore, each
of the aforementioned requests, in addition to any and every other request
not otherwise specifically reflected herein, is denied under N.J.S.A.
47:1A-1.1

Dear Sussex County,

 

Please accept this electronic request for public records made under OPRA
and the common law right of access.  I am not required to fill out an
official form or use a particular software platform to submit my request
per NJSA 47:1A-6(f), which states that an email from a requestor including
all of the information required on the adopted form shall suffice in place
of a completed form as a valid government record request.

 

I HAVE NOT been convicted of any indictable offense under the laws of New
Jersey, any other state, or the United States.

I’m not asking for the contents of any emails, passwords, or private
information. I just want to know which accounts exist or existed at that
time.

 

The goal is to understand which accounts were officially used during the
County’s reported email incident on October 31, 2025.

 

Notes

 

This type of list is considered a normal public record in New Jersey. The
law says public agencies should share basic information about who works
for the government and what accounts they use, as long as it doesn’t harm
security.

 

If anything must be withheld, please explain exactly why and cite the part
of OPRA that applies.

 

Please send the response by email in a PDF or spreadsheet. If this request
should go to someone else, please forward it and let me know who that is.

 

My preferred delivery method for response(s) to this request is by E-mail
as attachments.  Please confirm you have received this request.  If you
are not the custodian of records, please forward my request to that person
