Educational records and information regarding welfare check on my son Anthony
Dear Toms River School District,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

Under the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), I hereby request access to & copies of the following government records from Joseph A. Citta Elementary School & the Toms River Regional School District Administration:
1. External Communications to Law Enforcement & DCPP: Any & all emails, formal logs, internal documentation, written notes, phone logs, or electronic submissions sent to both law enforcement/municipal police & the Dept. Of Children & Families regarding my son, Anthony Guzman Jr., on or resulting in the welfare check by both the police & DCPP workers on 11/23/2025.
2. Internal Communications: Any & all internal emails, inter-office memos, messages, or text messages between administrators, teachers, guidance counselors, school nurses, or staff members at Joseph A. Citta Elementary School regarding the decision to request a law enforcement welfare check on Anthony Guzman Jr. on or about 11/23/2025.
3. Identity of Reporter: Any records or documents identifying the specific employee, official, or individual from Joseph A. Citta Elementary School who physically requested or initiated the welfare check with the police department & DCPP.
Legal Citations for Disclosure Support:
• Public Employee Identity: The identity of a public school employee acting in their official capacity to initiate a government/police action is a matter of public record & cannot be withheld under a blanket claim of privacy or anonymity.
• Parental Access Rights: Under the Family Educational Rights and Privacy Act (FERPA) & NJ
Administrative Code (N.J.A.C. 6A:32-7.5), as the legal parent & guardian of Anthony Guzman Jr., I have an absolute right to access any & all education & administrative records kept by the district regarding my child.
If this request is denied in whole or in part, please provide a detailed statutory justification for each redaction or denial as required by N.J.S.A. 47:1A-5(g), preserving my 45-day right to appeal.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person & provide their email address to me for future reference.

As stated in previous emails, student records cannot be released under
OPRA pursuant to FERPA. Since you provided the District with the signed
Cumulative Records Release Form which falls under FERPA (NOT OPRA), the
District has 45 days to provide your child's records.
Pursuant to your signed Cumulative Record Release form, please find
attached student records for your child.
