In January 2019, an OPRA request of a similar nature to was provided by your town and you specifically at no charge.
Furthermore, per N.J.S.A. 47:1A5.c, you may only assess a fee for a Special Charge or Extraordinary Request. I am asking for neither and am asking for it in electronic form.
I ask that you reivew the above in light of your request and reconsider, keeping in line with the OPRA request statute, prior fulfilled request, and GRC guidance.
I appreciate a prompt response regarding my request for reconsideration.

Dear Englishtown Borough,
Please pass this on to the person who conducts Open Public Records Act reviews for the Borough of Englishtown.
I am writing to request an internal review of Englishtown Borough's handling of my OPRA request 'E-Mail Logs'.
This request is now 6 weeks old. I have been more than patient to receive the information.
Requests like this have been fulfilled by your office in 2019 at no cost.
Other towns have provided this information to me of similar requests, both large and small size, in much quicker of a response time.

This is Councilman Gregory Wojyn. I would like to provide an update to the your request for email logs.
* The Borough Clerk, Peter Gorbatuk is out of the office on Leave as of last week until further notice. His exact date of return is not known at this time. His leave falls under HIPPA and I must respect the laws governing this matter.
Regarding your email log request:
* We do not have access to Mr. Gorbatuk's email account, so we would appreciate if you have any recent communications from the Government Records Council. Could you please forward them to me and CC the Clerk? This will help answer your questions.
Please understand the following:
* The clerk has been working hard to respond to your request, but he is not a Microsoft Outlook Administrator. That is not, and has never been, a part of his job description.
* The Borough of Englishtown does not have a dedicated Information Technology human resource. Any and all IT services performed for Englishtown is done by an outside contractor(s).
* No one working at the Borough has the specialized knowledge or is an authorized Microsoft Outlook 365 Administrator who can run specialized reports. Based on what I know, this request may also require programming knowledge to execute commands in Microsoft Exchange Online's PowerShell programming tool.
* We could have provided screen captures from Microsoft Outlook of the In Box and Outbox of the personnel you requested -- but your request was for the actual email logs -- and that request is far beyond the skills or certifications of any employee assigned to Clerk's office.
* In the meantime, we are trying to obtain a work-around for the fee our contractor would charge us and are trying to negotiate an agreement or seek a more cost-effective alternative.
I will restate my offer to help: If you would like screen captures of the email In Box and Out Box with subject lines and dates you want covered, that could be easily done at no cost to anyone.

As the Borough has previously provided this information at no charge exactly as I requested for a similar request in January 2019, I am requesting the actual logs and will await the reply of the Government Records Council as e-mailed to all parties on Friday, January 29th.

You are totally uninformed about the Microsoft Outlook 365 service used by the Clerk/administrative offices of Englishtown Borough and the email system that is used by the Englishtown Police Department. The Clerk does not have the technical knowledge regarding this and was incapable of explaining the differences.
Let me explain this to you one more time:
1. A.) The email system for the Englishtown Police and the Clerk's Office for the Borough of Englishtown are on 100% different servers, systems, and administrators. The only reason why you received an email log from the Englishtown Police Department is managed under a CJIS (Criminal Justice Information System). It is configured to run that way -- and the contract the Police Department has with its outsourced IT provider has it configured as such. I will repeat: The Police Department's CJIS email system has absolutely NOTHING to do with the Clerk's Office or the Microsoft Outlook 365 service the administrative offices use under an "a la carte" contract.
1. B.) The contract the Englishtown Police Department has is with an OUTSIDE VENDOR that provides services like email logs.
2) The Microsoft Outlook 365 service the administrative offices use under an "a la carte" contract. In all of the years that I have served on the Borough Council, I have no recollection of anyone asking the the Clerk's Office office for "email logs" of the kind you are requesting.
3) Since you have neither the technical knowledge, nor the contractual knowledge of the email systems, you are creating a false narrative that the Clerk's Office has provided email logs to either you or another entity in the past.
4) The Borough does not, and has not ever, employed a full-time Information Technology human resource that is CERTIFIED in Microsoft Outlook 365.
5) All of the Clerk's office's IT services are outsourced -- there is no one working as Clerk or in the Clerk's Office for the Borough of Englishtown that has ever been qualified to run detailed, back-end reports from Microsoft Outlook 365.
6) The report you are requesting is outside of the technical capabilities and knowledge of anyone in the Clerk's Office. They are not Microsoft Outlook Administrators and their job requirements have never called for such capabilities.
7) The Clerk's Office will gladly provide you, FREE OF CHARGE, with screen captures of the IN/OUT BOXES covering the dates requested and the subject lines. If you want something created by a Programmer or Certified Microsoft Technician, our IT Services already provided you with a quote your earlier message. The Borough is charging you for only the IT services of programming and running the email log request.
I hope this fully explains how the 2 email systems are 100% separate and have no connection whatsoever in functionality, reporting; etc.

Dear Councilman Gregory Wojyn,
Since you have chosen to accuse me of being "totally uniformed" and having "neither the technical knowledge, nor the contractual knowledge" (which I dispute) in requesting this information, I see no point in continuing this e-mail conversation and will cease this e-mail conversation with you.
I will await further guidance from the Government Records Council as per their e-mail on Friday, January 29th regarding this matter.
