Township School District (“Board” and/or “District”), I am writing this
letter in response to your request for records pursuant to the Open Public
Records Act (“OPRA”) submitted and received on 04/23/2026.

More specifically, your request seeks access to: I am requesting any
emails sent to Principal Orsolina Cetta and/or Adam Layman with subject

Based upon the items requested, your request requires additional time
beyond the seven business days to fulfill as the Board must identify all
the responsive documents, retrieve the documents, and redact any
non-disclosable/exempt information. The OPRA allows custodians to seek
extensions of time pursuant to N.J.S.A. 47:1A-5. Specifically, the OPRA

On behalf of the Custodian of Records, Laura Allen, for the Monroe
Township School District (“Board” and/or “District”), I am writing this
letter in response to your request for records pursuant to the Open Public
Records Act (“OPRA”) submitted and received on April 23, 2026.

More specifically, the Board responds to your request as set forth below:

“Emails sent to Principal Orsolina Cetta and/or Adam Layman with subject
heading or keyword "Dwyer" during the period January 1, 2026-April 22,
2026.”

As a preliminary matter, please be advised that personnel records are not
government records and are therefore prohibited from disclosure under the
OPRA. The OPRA only permits the disclosure of limited specific personnel
information, specifically, the disclosure of an individual’s name, title,
position, salary, payroll record, length of service, date of separation
and the reason for such separation, and the amount and type of any pension
received. See N.J.S.A. 47:1A-10; N.J.A.C. 6A:32-4.3; N.J.S.A.
10:4-12(b)(8); and Libertarians for Transparent Government v. Cumberland
County, 250 N.J. 46 (2022). 

In addition, there are longstanding regulations governing the
confidentiality of student records and limiting access to those requests
to a select few. See N.J.A.C. 6A:32-2.1; and -7.1 et seq. These
regulations are specifically authorized by N.J.S.A. 18A:36-19 and are a
corollary to the Family Educational Rights and Privacy Act (“FERPA”), 20
U.S.C. § 1232g; 34 CFR Part 99. 

More specifically, N.J.A.C. 6A:32-2.1 defines “student records” as
“information related to an individual student gathered within or outside
the school district and maintained within the school district, regardless
of the physical form in which it is maintained.” Student records, pursuant
to N.J.A.C. 6A:32-7.1, N.J.A.C. 6A:32-7.5, the Family Educational Rights
and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99) and other
applicable statutes, codes, regulations, etc., are confidential and are
prohibited from disclosure pursuant to the OPRA. Student records can only
be provided to individuals and organizations specifically authorized by
regulation to access those records. See N.J.A.C. 6A:32-7.1 and -7.5.
Student records are prohibited from disclosure because the OPRA does not
take into account who is requesting the records, unless the requester can
prove they are authorized to obtain same. See N.J.S.A. 47:1A-1 and -5; and
N.J.A.C. 6A:32-7.1, et seq.; L.R. v. Camden City Pub. Sch. Dist., 453 N.J.
Super 56 (App. Div. 2017); and Epstein, Esq. v. Hopewell Crest Board of
Education (Cumberland), GRC Complaint No. 2018-257 (June 2020). 

The Board conducted a thorough search and review of documents potentially
responsive to your request. Please be advised that there are a number of
emails which are exempt from disclosure, as those emails in their entirety
constitute confidential personnel information pursuant to N.J.S.A.
47:1A-10, N.J.A.C. 6A:32-4.3, and N.J.S.A. 10:4-12(b)(8) and/or
confidential student information pursuant to N.J.S.A. 47:1A-1.1 and -5,
N.J.S.A. 47:1A-9, N.J.A.C. 6A:32-7.1, et seq.; the Family Educational
Rights & Privacy Act (“FERPA”) (20 U.S.C. § 1232g; 34 CFR Part 99); and
L.R. v. Camden City Pub. Sch. Dist., 238 N.J. 547 (2019).

In accordance with the above, your request is hereby denied as a request
for confidential personnel records and/or confidential student records.

This correspondence and the foregoing information constitute the Board’s
full and complete response to your OPRA request and therefore, your OPRA
request is closed.
