Pursuant to the New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq., I am requesting access to the following government records:
1. Any and all police incident reports, arrest reports, summonses, or citations related to Driving While Intoxicated (DWI) incidents that occurred within the City of Orange on June 2, 2024.
2. Any related paperwork or documentation generated in connection with those incidents.
3. Any and all body-worn camera (BWC) footage recorded by officers during the response to and handling of any such DWI incidents on June 1, 2024.

I am requesting access to copies of these records in digital format if available. Please let me know if any fees will be incurred before fulfilling this request. If any portion of the records is exempt from disclosure, please redact only the exempt portions and provide the rest as required by law.

I am writing in response to your denial of my Open Public Records Act (OPRA) request, submitted on, in which I sought access to records related to a DWI incident that occurred on or around June 2nd 2024.

Your denial, fails to comply with New Jersey’s OPRA law (N.J.S.A. 47:1A-1 et seq.). Under OPRA, government records—including police reports, arrest records, motor vehicle stop details, and DWI incident documentation—are generally considered public records unless a specific exemption applies.

Please be advised of the following:
1. DWI incident records are not categorically exempt from disclosure under OPRA. While redactions may be made to protect personal identifiers or privileged information (e.g., victim identities, juvenile records, or medical data), the blanket denial of access to such records violates the spirit and letter of OPRA.
2. Anonymous requests are permitted under OPRA. N.J.S.A. 47:1A-5(f) clearly states that a requestor may file a request anonymously, and public agencies are required to honor such requests.
3. If the denial was based on a misapplication of privilege or a failure to cite a valid exemption, it must be reconsidered. OPRA mandates that all denials must include the legal basis and specific exemption relied upon for withholding records. A generalized refusal does not meet statutory requirements.

Accordingly, I respectfully request that you:
• Reconsider the denial and promptly release the requested records with appropriate redactions if necessary; or
• Provide a written explanation citing the specific statutory exemption under OPRA that justifies the continued withholding of the records.

If I do not receive a satisfactory response within seven (7) business days, I reserve the right to file a formal complaint with the Government Records Council or pursue legal remedies through the Superior Court of New Jersey.
